Stat. tit. 59, § 59-1105","heading":"Powers and duties of Department","body":"In addition to the other powers conferred by the Waterworks and\n\nWastewater Works Operator Certification Act, the Department shall\n\nhave the following powers and duties:\n\n1. To institute in any court of competent jurisdiction such\n\nactions or proceedings, including but not limited to actions and\n\nproceedings for mandatory or prohibitory injunctions or mandamus, as\n\nit may deem necessary either to enforce or to prevent violation of\n\nany provision of this act or of any rule or order made thereunder,\n\nor to enforce any subpoena or order issued or made under authority\n\nof the Waterworks and Wastewater Works Operator Certification Act;\n\n2. To conduct and cooperate with others in conducting\n\neducational and training programs, including itinerant training\n\nprograms or district meetings, concerning plant operation and\n\nrelated subjects;\n\n3. To employ such personnel, incur such expenses, and purchase\n\nsuch personal property as may be necessary for the purposes of this\n\nact, insofar as funds are lawfully available therefor;\n\n4. To prescribe such procedures and forms as may be necessary\n\nto the administration of the Waterworks and Wastewater Works\n\nOperator Certification Act;\n\n5. To prescribe the form and content of, and to grade and\n\ndetermine the criteria for the successful completion of,\n\nexaminations given to applicants and to provide for the\n\nconfidentiality of examinations and individual test scores;\n\n6. To perform such other acts as shall be necessary for the\n\naccomplishment of the purposes of the Waterworks and Wastewater\n\nWorks Operator Certification Act;\n\n7. To enforce the provisions of the Waterworks and Wastewater\n\nWorks Operator Certification Act, rules promulgated thereunder and\n\norders, certifications and registrations issued pursuant thereto;\n\nand\n\n8. To conduct voluntary certification programs, certification\n\nprograms specifically authorized by state statute, and certification\n\nprograms promulgated by the Environmental Quality Board pursuant to\n\na federal regulation or requirement; and to issue, renew or\n\nreactivate certificates and to register persons employed as helpers\n\npursuant to such programs.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"31a6c0be9c9e0b642d8b717852244a8f5f1f85ced4f41bc965591296cf21f511","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1104","next":"us-ok/okla.-stat.-tit.-59-59-1106"},"notice":"GroundRules: Original legal text.
