Stat. tit. 59, § 59-1151.16","heading":"Contractor's agent for service of process","body":"Every applicant for a roofing contractor's registration who is a\n\nnonresident contractor as defined by this act, by signing and filing\n\nthe application, appoints the Secretary of State as the applicant's\n\ntrue and lawful agent upon whom may be served all lawful process in\n\nany action or proceeding against such nonresident contractor for\n\nconstruction projects performed in this state. Such appointment in\n\nwriting is evidence of the roofing contractor's consent that any\n\nsuch process against the contractor which is so served upon the\n\nSecretary of State shall be of the same legal force and effect as if\n\nserved upon the contractor personally within this state. Registered\n\nforeign corporations, registered foreign limited liability\n\ncompanies, foreign limited liability partnerships and foreign\n\nlimited partnerships entitled to do business in this state and\n\nhaving a current registered agent and registered address on file in\n\nthe Office of the Secretary of State need not appoint the Secretary\n\nof State as agent for service of process under this section. Within\n\nten (10) days after service of the summons upon the Secretary of\n\nState, notice of such service with the summons and complaint in the\n\naction shall be sent to the defendant roofing contractor at the\n\ndefendant contractor's last-known address by registered or certified\n\nmail with return receipt requested and proof of such mailing shall\n\nbe attached to the summons. The Secretary of State shall keep a\n\nrecord of all process served upon the Secretary of State under this\n\nsection, showing the day and hour of service. Whenever service of\n\nprocess was made under this section, the court, before entering a\n\ndefault judgment, or at any stage of the proceeding, may order such\n\ncontinuance as may be necessary to afford the defendant contractor\n\nreasonable opportunity to defend any action pending against the\n\ndefendant contractor.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9260841b7babf4e105d897f376173e0b7dca0689561d4b06fa6f694ef83061a0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1151.15","next":"us-ok/okla.-stat.-tit.-59-59-1151.17"},"notice":"GroundRules: Original legal text.
