Stat. tit. 59, § 59-1151.2","heading":"Definitions","body":"As used in the Roofing Contractor Registration Act:\n\n1. \"Advertise\" means any written publication, dissemination,\n\nsolicitation, contract, bid, promotional item, or circulation which\n\nis intended to directly or indirectly induce any person to contract\n\nfor roofing construction services with the advertiser, including,\n\nbut not limited to, business cards, telephone directory display\n\nadvertisements, vehicle signage, radio, television and electronic\n\nsolicitations;\n\n2. \"Applicant\" means the qualifying party, or if no qualifying\n\nparty, any person applying under the Roofing Contractor Registration\n\nAct for a roofing contractor registration to be issued by the\n\nConstruction Industries Board;\n\n3. \"Board\" means the Construction Industries Board;\n\n4. \"Committee\" means the Committee of Roofing Examiners;\n\n5. \"Homeowner\" means one who owns and resides in, or who\n\nresides in, or who contracts for the purchase, construction,\n\nremodeling or repairing of a residence;\n\n6. \"Nonresident contractor\" means any contractor who has not\n\nestablished and maintained a place of business as a roofing\n\ncontractor in this state within the preceding year, or who claims\n\nresidency in another state, or who has not submitted an income tax\n\nreturn as a resident of this state within the preceding year;\n\n7. \"Owner\" means person who owns the property or is a lessee of\n\nthe property;\n\n8. \"Person\" means any natural person, firm, limited or general\n\npartnership, corporation, association, limited liability company,\n\ntrust, association, other legal entity and any organization capable\n\nof conducting business, or any combination thereof acting as a unit,\n\nunless the intent to give a more limited meaning is disclosed\n\nclearly by the Roofing Contractor Registration Act;\n\n9. \"Prime contractor\" means a general contractor, commercial\n\ncontractor, or other contractor who contracts directly with the\n\nowner for construction trade work in multiple trade areas;\n\n10. \"Project manager\" means one who manages construction\n\nprojects consisting of work involving multiple trades;\n\n11. \"Public contract\" means a contract with the State of\n\nOklahoma, its political subdivisions, or any board, commission, or\n\ndepartment thereof, or with any board of county commissioners, or\n\nwith any city council, school board, or with any state or municipal\n\nagency, or with any other public board, body, commission, or agency\n\nauthorized to award contracts for the construction or reconstruction\n\nof public works and includes subcontracts undertaken to perform\n\nworks covered by the original contract or any part thereof;\n\n12. \"Qualifying party\" means a natural person who is an officer\n\nor owner of the corporation, a member of the limited liability\n\ncompany, or a general partner of the limited liability partnership,\n\nand who is actively engaged in the work undertaken by the registrant\n\nfor which a registration is required pursuant to the Roofing\n\nContractor Registration Act who meets the experience and ability\n\nrequirements for registration on behalf of the registrant;\n\n13. \"Registrar\" means the Construction Industries Board or any\n\nperson designated by the Board to administer the provisions of the\n\nRoofing Contractor Registration Act;\n\n14. \"Registration\" means the process of applying for an initial\n\nor renewal registration which upon approval is exhibited by a\n\nregistration number and card issued pursuant to the Roofing\n\nContractor Registration Act;\n\n15. \"Registration number\" means the roofing registration number\n\nissued by the registrar to the registrant's qualifying party;\n\n16. \"Registrant\" means a holder of a registration issued\n\npursuant to the Roofing Contractor Registration Act;\n\n17. \"Residence\" means a single structure for residential\n\noccupancy or use which is a detached one- to four-family dwelling or\n\na multiple single-family dwelling (townhouse) not more than three\ntrant's qualifying party;\n\n16. \"Registrant\" means a holder of a registration issued\n\npursuant to the Roofing Contractor Registration Act;\n\n17. \"Residence\" means a single structure for residential\n\noccupancy or use which is a detached one- to four-family dwelling or\n\na multiple single-family dwelling (townhouse) not more than three\n\nstories/floors above grade plane in height with a separate means of\n\negress, and any appurtenances thereto, which is intended for use as\n\na primary habitation and is in compliance with the International\n\nResidential Code, as adopted by the Oklahoma Uniform Building Code\n\nCommission;\n\n18. \"Roofing contractor\" means any person, including a\n\nsubcontractor and nonresident contractor, engaged in the business of\n\ncommercial or residential roofing contractor work, or who himself or\n\nherself, or through another, attempts to or advertises, holds\n\nhimself or herself out as having, or purports to have, the capacity\n\nto undertake roofing contractor work, or offers to engage in or\n\nsolicits roofing installation-related services, including\n\nconstruction, installation, renovation, remodeling, reroofing,\n\nrepair, maintenance, alteration, and waterproofing, unless\n\nspecifically exempted in the Roofing Contractor Registration Act.\n\nRoofing contractor shall not mean:\n\na. a person engaged in the demolition of a structure or\n\nthe cleanup of construction waste and debris that\n\ncontains roofing material,\n\nb. a person working under the direct supervision of the\n\nroofing contractor who is hired either as an employee,\n\nday laborer, or contract laborer whose payment,\n\nreceived in any form, from the roofing contractor is\n\nsubject to self-employment tax,\n\nc. a person working on his or her own property or that of\n\nan immediate relative and such person is not receiving\n\nany compensation, or\n\nd. a person acting as a handyman who is receiving\n\ncompensation from the property owner and who is\n\nperforming the roofing repair in conjunction with\n\nother repairs to the property and who does not perform\n\nmore than two roofing jobs per year;\n\n19. \"Roofing contractor work\" means the installation,\n\nfabrication or assembly of equipment or systems included in roofing\n\nsystems as defined in the International Building Code and the\n\nInternational Residential Code, as adopted by the Oklahoma Uniform\n\nBuilding Code Commission, and which codes are hereby adopted and\n\nincorporated by reference. Roofing construction work includes, but\n\nis not limited to, installation, renovation, remodeling, reroofing,\n\nreconstructing, repair, maintenance, improvement, alteration, and\n\nwaterproofing, unless specifically exempted in the Roofing\n\nContractor Registration Act.\n\na. \"Commercial roofing contractor work\" means work done\n\non commercial, industrial or public building roofing\n\nsystems or structures as defined in the International\n\nBuilding Code, as adopted by the Oklahoma Uniform\n\nBuilding Code Commission; except it does not mean\n\nbuildings used for commercial purposes having\n\nequivalent or substantially the same roofing\n\nrequirements as a \"residence\" defined herein,\n\nincluding but not limited to business offices\n\nconverted from a structure that formerly was a\n\nresidence, and\n\nb. \"Residential roofing contractor work\" means work done\n\non roofing systems as defined in the International\n\nResidential Code, as adopted by the Oklahoma Uniform\n\nBuilding Code Commission, or as defined as a\n\n\"residence\" herein; including buildings used for\n\ncommercial purposes having asphalt shingles, tile\n\nshingles, synthetic shakes, wood shakes or other\n\ncomparable materials applied to a sloped roof equal to\n\nthe same roofing requirements as a \"residence\" defined\n\nherein, including but not limited to business offices\n\nconverted from a structure that formerly was a\n\nresidence;\n\n20. \"Roofing Hearing Board\" means the Roofing Hearing Board\ngs used for\n\ncommercial purposes having asphalt shingles, tile\n\nshingles, synthetic shakes, wood shakes or other\n\ncomparable materials applied to a sloped roof equal to\n\nthe same roofing requirements as a \"residence\" defined\n\nherein, including but not limited to business offices\n\nconverted from a structure that formerly was a\n\nresidence;\n\n20. \"Roofing Hearing Board\" means the Roofing Hearing Board\n\nwhich shall consist of a designee of the Construction Industries\n\nBoard, as chair, and the members of the Committee of Roofing\n\nExaminers;\n\n21. \"Subcontractor\" means one who contracts with a prime\n\ncontractor, general contractor, residential contractor, project\n\nmanager, property manager, another subcontractor, or another entity\n\nfor roofing contractor work;\n\n22. \"Variance\" means the use of an alternative material or\n\nmethod of construction from that prescribed in the International\n\nBuilding Code or the International Residential Code or other\n\napproved documents by the Oklahoma Uniform Building Code Commission\n\nfor use at a particular location or project specified in the\n\nvariance application;\n\n23. \"Variance and Appeals Board\" means the Oklahoma State\n\nRoofing Installation Code Variance and Appeals Board;\n\n24. \"Labor-only crews\" means a crew that is to perform the\n\ninstallation of asphalt shingles, tile shingles, synthetic shakes,\n\nwood shakes or other comparable materials to a sloped roof and to\n\ncomplete roofing work; and\n\n25. \"Prefabricated- or pre-engineered-metal-building erector\"\n\nmeans the labor necessary to construct the components of a\n\nprefabricated- or pre-engineered-metal-building package, known as\n\nPEMB, as defined by the Construction Science Institute and\n\nConstruction Specifications Institute in Division 13, Special\n\nConstruction: Metal Building Systems.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a790900ad4c94e9e7c862f04c361949eb7d424668acfa7dde90015c729eba2f0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1151.19","next":"us-ok/okla.-stat.-tit.-59-59-1151.20"},"notice":"GroundRules: Original legal text.
