The designee of the Construction Industries Board, as chair,\n\nand the Committee of Roofing Examiners shall act as the Roofing\n\nHearing Board and shall comply with the provisions of the\n\nConstruction Industries Board Act, rules and Article II of the\n\nAdministrative Procedures Act.\n\nB. Any administrative hearing on suspensions, revocations or\n\nfines shall be conducted by a hearing examiner appointed by the\n\nConstruction Industries Board. The hearing examiner's decision\n\nshall be a final decision which may be appealed to a district court\n\nin accordance with the Administrative Procedures Act and the\n\nConstruction Industries Board Act and rules and regulations.\n\nC. The Roofing Hearing Board may, upon its own motion, and\n\nshall, upon written complaint filed by any person, investigate and\n\nconduct hearings on the business transactions of any roofing\n\ncontractor, firm or any person soliciting or engaging in roofing\n\ncontractor work.\n\nD. The Roofing Hearing Board may conduct hearings on citations\n\nissued to any person pursuant to the Roofing Contractor Registration\n\nAct, applications for suspension and revocation of a registration or\n\nendorsement.\n\nE. The Construction Industries Board shall suspend or revoke or\n\nmay refuse to issue or renew any license or registration under the\n\ncommercial roofer endorsement provisions of the Roofing Contractor\n\nRegistration Act for any of the following standards of the Roofing\n\nContractor Registration Act:\n\n1. Making a material misstatement in the application for an\n\nendorsement, or the renewal of an endorsement;\n\n2. Obtaining any endorsement by false or fraudulent\n\nrepresentation;\n\n3. Loaning or allowing the use of such endorsement by any other\n\nperson or illegally using an endorsement;\n\n4. Demonstrating incompetence to act as a commercial roofing\n\ncontractor;\n\n5. Violating any provisions of the Roofing Contractor\n\nRegistration Act, or any rule or order prescribed by the\n\nConstruction Industries Board pursuant to the provisions of the\n\nRoofing Contractor Registration Act; or\n\n6. Willfully failing to perform normal business obligations\n\nwithout justifiable cause.\n\nF.
