Stat. tit. 59, § 59-1151.3","heading":"Roofing contractor registration – Violations –","body":"Penalties – Enjoinment of prohibited acts or practices.\n\nA. All roofing contractors shall be registered annually by the\n\nBoard. All registrations shall be nontransferable. It is unlawful\n\nfor any person to act as a roofing contractor without having a\n\ncurrent and valid roofing contractor's registration or act as a\n\ncommercial roofing contractor without a current and valid commercial\n\nroofer endorsement issued pursuant to the Roofing Contractor\n\nRegistration Act, unless the person is exempt under the Roofing\n\nContractor Registration Act. Evidence of securing a permit,\n\nincluding roofing work from a governmental agency or the employment\n\nof a person on a roofing project, shall be accepted in any court as\n\nprima facie evidence of the existence of a contract.\n\nEach copy of a roofing contractor's record, which would include\n\nresponses to any complaints, that is from and verified by the\n\nregistrar, or a verified statement from the registrar that there is\n\nno record as no application was made, shall be received in all\n\ncourts in this state as prima facie evidence of the facts stated\n\ntherein.\n\nA verified copy of a roofing contractor's administrative\n\ncitation for unregistered activity or without required commercial\n\nroofer endorsement and order of final disposition from the registrar\n\nshall be received in all courts in this state as prima facie\n\nevidence of the facts stated therein, including establishment\n\nthereby of the first offense.\n\nB. A person shall not engage or offer to engage in, by\n\nadvertisement or otherwise, the business nor act in the capacity of\n\na roofing contractor within this state nor shall that person bring\n\nor maintain any claim, action, suit, or proceeding in any court of\n\nthis state related to the person's business or capacity as a roofing\n\ncontractor without a valid registration and commercial roofer\n\nendorsement, when required, continuously while performing the work\n\nfor which the claim, action, suit, or proceeding is sought, as\n\nprovided in the Roofing Contractor Registration Act. No business\n\nentity shall advertise or act as a roofing contractor unless such\n\nbusiness is a registered roofing contractor with a valid commercial\n\nroofer endorsement, when required, and is in good standing, and is\n\nassociated with and responsible for all roofing contractor work of\n\nsuch entity. Any business entity violating the provisions of this\n\nsubsection shall be subject to administrative penalty by the Board\n\nnot to exceed Five Thousand Dollars ($5,000.00).\n\nC. A person who fails to obtain a valid registration and\n\nendorsement when required prior to advertising or offering to engage\n\nas or acting as a roofing contractor as defined in the Roofing\n\nContractor Registration Act, or a person who acts as a roofing\n\ncontractor while his or her registration is not in good standing or\n\nis suspended or revoked without complying with the required\n\ndisclosure and option for homeowner to cancel the contract\n\nprovisions of subsection I of Section 1151.5 of this title, or a\n\nperson who violates any provision of the Roofing Contractor\n\nRegistration Act, shall be guilty of a misdemeanor, upon conviction\n\nor plea, punishable by a fine not to exceed Five Hundred Dollars\n\n($500.00) for each violation. More than one misdemeanor violation\n\nin any twelve-month period shall be grounds for the suspension of\n\nthe registration, and shall cause the person to be ineligible for\n\nregistration for a period not to exceed twenty-four (24) months\n\nafter all requirements of the sentence, or deferment of sentence,\n\nand probation have been met, including the payment of any\n\nrestitution or rehabilitative treatment.\n\nD. In lieu of referring complaints of violations of the Roofing\n\nContractor Registration Act to the district attorney for misdemeanor\n\nprosecution, the Board in its discretion may issue administrative\n\nfines to any person up to Five Hundred Dollars ($500.00) for\nsentence, or deferment of sentence,\n\nand probation have been met, including the payment of any\n\nrestitution or rehabilitative treatment.\n\nD. In lieu of referring complaints of violations of the Roofing\n\nContractor Registration Act to the district attorney for misdemeanor\n\nprosecution, the Board in its discretion may issue administrative\n\nfines to any person up to Five Hundred Dollars ($500.00) for\n\nviolations of any provision of the Roofing Contractor Registration\n\nAct or its rules or regulations. A person who fails to obtain a\n\nvalid registration prior to acting as a roofing contractor, or a\n\nperson who acts as a roofing contractor while his or her\n\nregistration or commercial roofer endorsement is not in good\n\nstanding or is suspended or revoked without complying with the\n\nrequired disclosure and option for homeowner to cancel the contract\n\nprovisions of subsection I of Section 1151.5 of this title, on first\n\noffense, may be administratively fined and disciplined after notice\n\nand opportunity for hearing before the Roofing Hearing Board. A\n\nperson who violates any other provision of the Roofing Contractor\n\nRegistration Act, on first offense within a two-year period, may be\n\nadministratively fined and disciplined by the Roofing Hearing Board\n\nin its discretion in lieu of referral to the district attorney as a\n\nmisdemeanor, or the matter may be referred to the district attorney.\n\nMisdemeanor conviction, guilty plea, or nolo contendere plea due to\n\nalleged violations of the Roofing Contractor Registration Act shall\n\nbe grounds for the revocation of the registration and shall cause\n\nthe person to be ineligible for registration for a period not to\n\nexceed twelve (12) months after all requirements of the sentence, or\n\ndeferment of sentence, and probation have been met, including the\n\npayment of any restitution or rehabilitative treatment.\n\nE. Administrative fines collected pursuant to the Roofing\n\nContractor Registration Act shall be placed in the Roofing\n\nContractor Registration Revolving Fund pursuant to Section 1151.20\n\nof this title.\n\nF. It is the duty of the building official or other authority\n\ncharged with the duty of issuing roofing permits of any incorporated\n\nmunicipality or subdivision of the municipality or county to refuse\n\nto issue a roofing permit for any roofing undertaking which would\n\nrequire a registration pursuant to the Roofing Contractor\n\nRegistration Act unless the applicant has furnished evidence that he\n\nor she is either registered as required or is exempt from the\n\nregistration requirements of the Roofing Contractor Registration\n\nAct.\n\nG. The Roofing Hearing Board may make application to the\n\nappropriate court for an order enjoining the acts or practices\n\nprohibited by the Roofing Contractor Registration Act, and upon a\n\nshowing by the Roofing Hearing Board that the person or firm has\n\nengaged in, or is about to engage in, any of the prohibited acts or\n\npractices, an injunction, restraining order or other order as may be\n\nappropriate shall be granted by the court.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a334b7fc7c46c5af51ad1cb9f5079e3814c82ac6dcaf95ed9f728e9b2a73faea","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1151.2a","next":"us-ok/okla.-stat.-tit.-59-59-1151.30"},"notice":"GroundRules: Original legal text.
