Stat. tit. 59, § 59-1151.30","heading":"Offer to pay insurance deductible or to compensate for","body":"providing service.\n\nA. A residential or commercial roofing contractor providing\n\nrepairs or improvement services to be paid by an insured from the\n\nproceeds of a property or casualty insurance policy shall not, as an\n\ninducement to the sale or provision of goods or services to an\n\ninsured, advertise or promise to pay, directly or indirectly, all or\n\npart of any applicable insurance deductible or offer to compensate\n\nan insured for providing any service to the insured. If a roofing\n\ncontractor violates the provisions of this section, the insurer to\n\nwhom the insured tendered the claim shall not be obligated to\n\nconsider the estimate prepared by the roofing contractor. Every\n\nroofing contractor shall provide a written notification of the\n\nrequirements of this section with its initial estimate. The\n\nadjuster or insurer shall provide a written notification of the\n\nrequirements of this section in the initial estimate relating to the\n\nclaim.\n\nB. Any person may file a written duly verified complaint with\n\nthe registrar alleging a violation of this section. The complaint\n\nshall be on a form approved by the registrar and shall set forth the\n\nalleged act or omission provided in subsection A of this section,\n\nand a statement of sufficient facts upon which a reasonable person\n\ncould conclude that the act or omission specified in subsection A of\n\nthis section has been committed. All complaints filed with the\n\nregistrar shall be open to public inspection. Nothing in this\n\nsection shall be construed to require the complainant to first file\n\na complaint with the registrar before seeking relief or remedies\n\nallowed by law.\n\nC. 1. The registrar shall forward all complaints alleging\n\nviolations of this section to the Insurance Department and the\n\nOffice of the Attorney General for investigation, enforcement, and\n\nprosecution of any alleged violation.\n\n2. A complaint received by the registrar pursuant to this\n\nsection shall be referred to the district attorney for appropriate\n\ndisposition as determined by the district attorney in his or her\n\ndiscretion.\n\nD.
