Stat. tit. 59, § 59-1282","heading":"Definitions","body":"As used in this Compact, and except as otherwise provided, the\n\nfollowing definitions shall apply:\n\nA. “Active Military Member” means any individual with full-time\n\nduty status in the active Armed Forces of the United States\n\nincluding members of the National Guard and Reserve;\n\nB. “Adverse Action” means any administrative, civil, equitable,\n\nor criminal action permitted by a State’s laws which is imposed by a\n\nLicensing Authority or other authority against a Regulated Social\n\nWorker, including actions against an individual’s license or\n\nMultistate Authorization to Practice such as revocation, suspension,\n\nprobation, monitoring of the Licensee, limitation on the Licensee’s\n\npractice, or any other Encumbrance on licensure affecting a\n\nRegulated Social Worker’s authorization to practice, including\n\nissuance of a cease and desist action;\n\nC. “Alternative Program” means a nondisciplinary monitoring or\n\npractice remediation process approved by a Licensing Authority to\n\naddress practitioners with an Impairment;\n\nD. “Charter Member States” means Member States who have enacted\n\nlegislation to adopt this Compact where such legislation predates\n\nthe effective date of this Compact as described in Section 14 of\n\nthis act;\n\nE. “Compact Commission” or “Commission” means the government\n\nagency whose membership consists of all States that have enacted\n\nthis Compact, which is known as the Social Work Licensure Compact\n\nCommission, as described in Section 10 of this act, and which shall\n\noperate as an instrumentality of the Member States;\n\nF. “Current Significant Investigative Information” means:\n\n1. Investigative information that a Licensing Authority, after\n\na preliminary inquiry that includes notification and an opportunity\n\nfor the Regulated Social Worker to respond, has reason to believe is\n\nnot groundless and, if proved true, would indicate more than a minor\n\ninfraction as may be defined by the Commission; or\n\n2. Investigative information that indicates that the Regulated\n\nSocial Worker represents an immediate threat to public health and\n\nsafety, as may be defined by the Commission, regardless of whether\n\nthe Regulated Social Worker has been notified and has had an\n\nopportunity to respond;\n\nG. “Data System” means a repository of information about\n\nLicensees, including continuing education, examination, licensure,\n\nCurrent Significant Investigative Information, Disqualifying Event,\n\nMultistate License(s) and Adverse Action information or other\n\ninformation as required by the Commission;\n\nH. “Disqualifying Event” means any Adverse Action or incident\n\nwhich results in an Encumbrance that disqualifies or makes the\n\nLicensee ineligible to either obtain, retain, or renew a Multistate\n\nLicense;\n\nI. “Domicile” means the jurisdiction in which the Licensee\n\nresides and intends to remain indefinitely;\n\nJ. “Encumbrance” means a revocation or suspension of, or any\n\nlimitation on, the full and unrestricted practice of Social Work\n\nlicensed and regulated by a Licensing Authority;\n\nK. “Executive Committee” means a group of delegates elected or\n\nappointed to act on behalf of, and within the powers granted to them\n\nby, the Compact and Commission;\n\nL. “Home State” means the Member State that is the Licensee’s\n\nprimary Domicile;\n\nM. “Impairment” means a condition(s) that may impair a\n\npractitioner’s ability to engage in full and unrestricted practice\n\nas a Regulated Social Worker without some type of intervention and\n\nmay include alcohol and drug dependence, mental health impairment,\n\nand neurological or physical impairments;\n\nN. “Licensee(s)” means an individual who currently holds a\n\nlicense from a State to practice as a Regulated Social Worker;\n\nO. “Licensing Authority” means the board or agency of a Member\n\nState, or equivalent, that is responsible for the licensing and\n\nregulation of Regulated Social Workers;\n\nP. “Member State” means a state, commonwealth, district, or\nt,\n\nand neurological or physical impairments;\n\nN. “Licensee(s)” means an individual who currently holds a\n\nlicense from a State to practice as a Regulated Social Worker;\n\nO. “Licensing Authority” means the board or agency of a Member\n\nState, or equivalent, that is responsible for the licensing and\n\nregulation of Regulated Social Workers;\n\nP. “Member State” means a state, commonwealth, district, or\n\nterritory of the United States of America that has enacted this\n\nCompact;\n\nQ. “Multistate Authorization to Practice” means a legally\n\nauthorized privilege to practice, which is equivalent to a license,\n\nassociated with a Multistate License permitting the practice of\n\nSocial Work in a Remote State;\n\nR. “Multistate License” means a license to practice as a\n\nRegulated Social Worker issued by a Home State Licensing Authority\n\nthat authorizes the Regulated Social Worker to practice in all\n\nMember States under Multistate Authorization to Practice;\n\nS. “Qualifying National Exam” means a national licensing\n\nexamination approved by the Commission;\n\nT. “Regulated Social Worker” means any clinical, master’s or\n\nbachelor’s Social Worker licensed by a Member State regardless of\n\nthe title used by that Member State;\n\nU. “Remote State” means a Member State other than the\n\nLicensee’s Home State;\n\nV. “Rule(s)” or “Rule(s) of the Commission” means a regulation\n\nor regulations duly promulgated by the Commission, as authorized by\n\nthe Compact, that has the force of law;\n\nW. “Single State License” means a Social Work license issued by\n\nany State that authorizes practice only within the issuing State and\n\ndoes not include Multistate Authorization to Practice in any Member\n\nState;\n\nX. “Social Work” or “Social Work Services” means the\n\napplication of social work theory, knowledge, methods, ethics, and\n\nthe professional use of self to restore or enhance social,\n\npsychosocial, or biopsychosocial functioning of individuals,\n\ncouples, families, groups, organizations, and communities through\n\nthe care and services provided by a Regulated Social Worker as set\n\nforth in the Member State’s statutes and regulations in the State\n\nwhere the services are being provided;\n\nY. “State” means any state, commonwealth, district, or\n\nterritory of the United States of America that regulates the\n\npractice of Social Work;
