This Compact and the Commission’s rulemaking authority shall\n\nbe liberally construed so as to effectuate the purposes and the\n\nimplementation and administration of the Compact. Provisions of the\n\nCompact expressly authorizing or requiring the promulgation of Rules\n\nshall not be construed to limit the Commission’s rulemaking\n\nauthority solely for those purposes.\n\nB. The provisions of this Compact shall be severable and if any\n\nphrase, clause, sentence, or provision of this Compact is held by a\n\ncourt of competent jurisdiction to be contrary to the constitution\n\nof any Member State, a State seeking participation in the Compact,\n\nor of the United States, or the applicability thereof to any\n\ngovernment, agency, person, or circumstance is held to be\n\nunconstitutional by a court of competent jurisdiction, the validity\n\nof the remainder of this Compact and the applicability thereof to\n\nany other government, agency, person or circumstance shall not be\n\naffected thereby.\n\nC. Notwithstanding subsection B of this section, the Commission\n\nmay deny a State’s participation in the Compact or, in accordance\n\nwith the requirements of subsection C of Section 13 of this act,\n\nterminate a Member State’s participation in the Compact, if it\n\ndetermines that a constitutional requirement of a Member State is a\n\nmaterial departure from the Compact.
