Sections 1301 through 1341 of this title shall only apply to\n\nthe regulation of bail bonds for crimes, the punishment of which may\n\nbe in excess of Twenty Dollars ($20.00) fine or twenty (20) days in\n\njail, or both such fine and imprisonment.\n\nB. As used in Sections 1301 through 1341 of this title:\n\n1. \"Commissioner\" means the Insurance Commissioner of the State\n\nof Oklahoma;\n\n2. \"Clerk\" means the district or municipal court clerk;\n\n3. \"Insurer\" means any domestic, foreign or alien surety\n\ncompany which has qualified generally to transact surety business\n\nand specifically to transact bail bond business in this state and\n\nany professional bondsman or multicounty agent bondsman;\n\n4. \"Bail bondsman\" means a surety bondsman, professional\n\nbondsman, multicounty agent bondsman, property bondsman, or a cash\n\nbondsman as hereinafter defined;\n\n5. \"Surety bondsman\" means any person who has been approved by\n\nthe Commissioner and appointed by an insurer by power of attorney to\n\nexecute or countersign bail bonds for the insurer in connection with\n\njudicial proceedings and charges and receives money for his or her\n\nservices;\n\n6. \"Managing general agent\" (M.G.A.) means any person acting in\n\nthe capacity of supervisor or manager over a licensed bondsman, who\n\nhas been granted the authority or responsibility by an insurer to\n\nconduct surety business on its behalf, and to oversee the activities\n\nand conduct of the appointed licensed bondsman agents of the\n\ninsurer, and who generally functions as an intermediate manager\n\nbetween the insurer and its licensed bondsman agents. A managing\n\ngeneral agent fulfilling these functions shall be a natural person,\n\nshall meet the qualifications of paragraph 5 of this subsection and\n\nshall be licensed as a bondsman;\n\n7. \"Professional bondsman\" means any person who has been\n\napproved by the Commissioner and who pledges cash as security for a\n\nbail bond in connection with a judicial proceeding and charges and\n\nreceives money for his or her services;\n\n8. \"Property bondsman\" means any person who has been approved\n\nby the Commissioner and who pledges real property as security for a\n\nbail bond in a judicial proceeding and charges and receives money\n\nfor his or her services;\n\n9. \"Cash bondsman\" means any person who has been approved by\n\nthe Commissioner and who deposits cash money as security for a bail\n\nbond in a judicial proceeding and charges and receives money for his\n\nor her services;\n\n10. \"Escrow deposit\" means cash or valuable security deposited\n\nby an insurer to secure the face amount of forfeiture pending\n\nappeal;\n\n11. \"Solicitation\" means to ask for earnestly, seek to obtain\n\nby persuasion or entreaty, implore, beseech, tempt or entice a\n\nperson directly or through another person by personal, mechanical,\n\nprinted or published means to purchase a bail bond. Solicitation\n\nshall not include mass communication advertising, which shall\n\ninclude, but not be limited to, television, newspapers, magazines\n\nand billboards;\n\n12. \"Bond\" means an appearance bond for a specified monetary\n\namount which is executed by the defendant and a licensed bondsman\n\npursuant to the provisions of Section 1301 et seq. of this title and\n\nwhich is issued to a court clerk as security for the subsequent\n\ncourt appearance of the defendant upon release from actual custody\n\npending the appearance; and\n\n13. \"Multicounty agent bondsman\" means a professional bondsman\n\nwho has been approved by the Commissioner and who otherwise complies\n\nwith the provisions of Section 1306.1 of this title.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2b7d3d6346baf4c67a82a3172038a794f39f8b2f9820d6c2c9cf17b5aeaa5df5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1296","next":"us-ok/okla.-stat.-tit.-59-59-1302"},"notice":"GroundRules: Original legal text.
