Stat. tit. 59, § 59-1311.2","heading":"Denial, suspension, revocation or refusal to renew","body":"license - Effect.\n\nA. No individual operating under any license which has been\n\nrevoked by the Insurance Commissioner shall have the right to apply\n\nfor another license under this act within one (1) year from the\n\neffective date of such revocation, or, if judicial review of such\n\nrevocation is sought, within one (1) year from the date of final\n\ncourt order or decree affirming the revocation. However, the\n\nCommissioner may authorize the application for another license under\n\nthis act by such an individual prior to the end of the one-year\n\nperiod if the Commissioner finds that the individual meets the\n\nlicensing requirements then in effect and if the Commissioner finds\n\nthe circumstances for which the license was revoked no longer\n\nexists. The Commissioner shall not, however, grant a new license to\n\nany individual if he finds that the circumstances for which the\n\nprevious license was revoked still exist or are likely to recur.\n\nB. If a license as bail bondsman as to the same individual has\n\nbeen revoked at two separate times, the Commissioner may not\n\nthereafter grant or issue any license under this act as to such\n\nindividual unless such individual can meet the licensing\n\nqualifications then in effect and if the Commissioner finds the\n\ncircumstances for which the license was revoked no longer exists.\n\nC. During the period of suspension, or after revocation of the\n\nlicense and prior to being issued a new license, the former licensee\n\nshall not engage in or attempt to profess to engage in any\n\ntransaction or business for which a license is required under this\n\nact.\n\nD. Upon suspension, revocation or refusal to renew or continue\n\nthe license of a bail bondsman, the Commissioner may at the same\n\ntime likewise suspend or revoke all other insurance agent licenses\n\nheld by the licensee under the insurance laws of this state, if the\n\nCommissioner determines that such suspension or revocation is in the\n\nbest interest of the public.\n\nE. In case of the suspension or revocation of license of any\n\nbail bondsman, the license of any and all bail bondsmen who are\n\nmembers of a bail bond agency, whether incorporated or\n\nunincorporated, and who knowingly are parties to the act which\n\nformed the ground for the suspension or revocation may likewise be\n\nsuspended or revoked for the same period as that of the offending\n\nbail bondsman; but this shall not prevent any bail bondsman, except\n\nthe one whose license was first suspended or revoked or the bondsman\n\nmember of the agency who was a knowing participant, from being\n\nlicensed as a member of some other bail bond agency.\n\nF. Though issued to a licensee, all certificates of licenses\n\nissued under this act are at all times the property of this state,\n\nand upon notice of any suspension, revocation, refusal to renew,\n\nexpiration or other termination of the license, the licensee or\n\nother person having either the original or copy of the license shall\n\npromptly deliver the certificate of license or copy thereof to the\n\nCommissioner for cancellation.\n\nG. As to any certificate of license lost, stolen or destroyed\n\nwhile in the possession of any such licensee or person, the\n\nCommissioner may accept in lieu of return of the certificate, the\n\naffidavit of the licensee or other person responsible for or\n\ninvolved in the safekeeping of such certificate, concerning the\n\nfacts of such loss, theft or destruction. Willful falsification of\n\nany such affidavit shall, upon conviction, be subject to punishment\n\nas for perjury.\n\nH.
