The following persons or classes shall not be bail bondsmen,\n\nshall not perform the acts of a bail bondsman and shall not directly\n\nor indirectly receive any benefits from the execution of any bail\n\nbond:\n\n1. Persons convicted of, or who have pled guilty or nolo\n\ncontendere to, any felony or to a misdemeanor involving dishonesty\n\nor moral turpitude;\n\n2. Jailers;\n\n3. Police officers;\n\n4. Committing judges;\n\n5. Municipal or district court judges;\n\n6. Prisoners;\n\n7. Sheriffs, deputy sheriffs and any person having the power to\n\narrest or having anything to do with the control of federal, state,\n\ncounty or municipal prisoners;\n\n8. Any person who holds any license provided for in Section 2-\n\n101 of Title 37A of the Oklahoma Statutes or is an agent or officer\n\nof any such licensee, except for an individual holding an employee\n\nlicense pursuant to paragraph 22 of subsection A of Section 2-101 of\n\nTitle 37A of the Oklahoma Statutes or as specifically authorized for\n\na licensed bondsman in Section 1315.1 of this title;\n\n9. Any person who holds any license or permit from any city,\n\ntown, county, or other governmental subdivision for the operation of\n\nany private club at which alcoholic beverages are consumed or\n\nprovided, except as specifically authorized for a licensed bondsman\n\nin Section 1315.1 of this title;\n\n10. Any person or agent of a retail liquor package store; and\n\n11. Any person whose bail bondsman license has been revoked by\n\nthe Insurance Commissioner.\n\nB. This section shall not apply to a sheriff, deputy sheriff,\n\npolice officer, or officer of the law who is not on duty and who\n\nassists in the apprehension of a defendant.\n\nC. The provisions of this section shall not apply to persons\n\npossessing permits or licenses pertaining to alcoholic beverages, as\n\ndefined in Section 1-103 of Title 37A of the Oklahoma Statutes,\n\nwhich were issued prior to May 23, 1984. No one shall be permitted\n\nto maintain an office for conducting bail bonds business where\n\nalcoholic beverages are sold for on-premises consumption.\n\nD. No person shall be permitted to maintain an office for\n\nconducting a bail bond business where persons disqualified pursuant\n\nto paragraph 1 of subsection A of this section are present, except\n\nas necessary for such persons to obtain a personal bail bond.\n\nE. For purposes of this section, the marriage or cohabitation\n\nof a bail bond licensee or license applicant with a person\n\ndisqualified pursuant to subsection A of this section does not, as a\n\nmatter of fact, constitute the receipt of benefits from the\n\nexecution of a bail bond.
