Every bondsman shall file with the undertaking an affidavit\n\nstating whether or not the bondsman or anyone for the use of the\n\nbondsman has been promised or has received any security or\n\nconsideration for the undertaking, and if so, the nature and\n\ndescription of security and amount thereof, and the name of the\n\nperson by whom the promise was made or from whom the security or\n\nconsideration was received. Any willful misstatement in the\n\naffidavit relating to the security or consideration promised or\n\ngiven shall render the person making it subject to the same\n\nprosecution and penalty as one who commits the felony of perjury, a\n\nClass D1 felony offense punishable as provided for in subsections B\n\nthrough F of Section 20N of Title 21 of the Oklahoma Statutes.\n\nB. An action to enforce any indemnity agreement shall not lie\n\nin favor of the surety against the indemnitor, except with respect\n\nto agreements set forth in the affidavit. In an action by the\n\nindemnitor against the surety to recover any collateral or security\n\ngiven by the indemnitor, the surety shall have the right to retain\n\nonly the security or collateral as it mentioned in the affidavit\n\nrequired by this section.\n\nC. If security or consideration other than that reported on the\n\noriginal affidavit is received after the affidavit is filed with the\n\ncourt clerk, an amended affidavit shall be filed with the court\n\nclerk indicating the receipt of security or consideration.\n\nD. If a bondsman accepts a mortgage on real property as\n\ncollateral on a bond, the bondsman shall file a copy of the mortgage\n\nwith the bond within thirty (30) days of receipt of the mortgage.\n\nThe Commissioner shall have the authority to extend or waive this\n\nrequirement.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9ab7d781fbfad90d4068cdc550399d5c6a86898ce2459b034e8f9a3181f9776d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1321","next":"us-ok/okla.-stat.-tit.-59-59-1323"},"notice":"GroundRules: Original legal text.
