The bondsman or insurer, or a licensed bail enforcer\n\npursuant to a client contract authorized by the Bail Enforcement and\n\nLicensing Act, desiring to make a surrender of the defendant shall\n\nprocure or have in his or her possession a certified copy of the\n\nundertakings and deliver such documents together with the defendant\n\nto the official in whose custody the defendant was at the time bail\n\nwas taken, or to the official into whose custody he or she would\n\nhave been given had he or she been committed, who shall detain the\n\ndefendant in custody thereon, as upon a commitment, and by a\n\ncertificate in writing acknowledge the surrender.\n\nUpon the presentation of a certified copy of the undertaking and\n\nthe certificate of the official, the court before which the\n\ndefendant has been held to answer, or the court in which the\n\npreliminary examination, indictment, information or appeal is\n\npending, shall upon notice of three (3) days given by the person\n\nmaking the surrender to the prosecuting officer of the court having\n\njurisdiction of the offense, together with a copy of the\n\nundertakings and certificate, order that the obligors be exonerated\n\nfrom liability on their undertakings, and, if money has been\n\ndeposited as bail, that such money or bonds be refunded. If\n\nproperty pledged, a certificate of exoneration be issued and the\n\nlien previously filed be released and the undertakings of whatever\n\nnature be canceled.\n\nIf certified copies of bonds are not reasonably available, the\n\nbondsman or insurer may recommit the defendant to be held in custody\n\non the charges for which the bondsman or insurer has previously\n\nposted appearance bonds thereon in accordance with the following\n\nprocedure:\n\n1. On a Recommitment of Defendant by Bondsman form approved by\n\nthe Administrative Office of the Courts, the bondsman or insurer\n\nshall personally affix his or her signature to an affidavit\n\nattesting to the following:\n\na. the bondsman or insurer has posted a bond or bonds for\n\nthe defendant and is hereby presented to the official\n\nin whose custody the defendant was at the time bail\n\nwas taken,\n\nb. the case number, if any, assigned to each bond, and\n\nc. the specific charges and bond amount or amounts;\n\n2. The bondsman or insurer shall present the Recommitment of\n\nDefendant by Bondsman form to the official in whose custody the\n\ndefendant is being surrendered, and the official shall detain the\n\ndefendant in his or her custody thereon, as upon a commitment, and\n\nby a certificate in writing acknowledging the surrender; and\n\n3. When a bondsman or insurer recommits a defendant pursuant to\n\nthis subsection, the bondsman or insurer shall file a written\n\nnotification thereof to the court clerk, and after such\n\nnotification, the bond or bonds shall be exonerated and the clerk\n\nshall enter a minute in the case exonerating the bond or bonds.\n\nB. Any bail bondsman engaged in the apprehension or surrender\n\nof his or her defendant client, and any bail bondsman assisting\n\nanother bondsman pursuant to Section 1311.4 of this title, shall at\n\nall times while engaged in the apprehension or surrender of the\n\ndefendant client have his or her bail bondsman license in his or her\n\npossession and shall present the license to any law enforcement\n\nofficer immediately upon request.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0cd2e16a9714f21592a150d0cdd10ddc759bfd2792f0b97f2537d203d1532005","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1327","next":"us-ok/okla.-stat.-tit.-59-59-1329"},"notice":"GroundRules: Original legal text.
