Stat. tit. 59, § 59-1350.11","heading":"Denial, suspension, or revocation and disciplinary","body":"action.\n\nA. A bail enforcer license or armed bail enforcer license shall\n\nbe subject to denial, suspension, or revocation and/or disciplinary\n\naction or administrative fine by the Council on Law Enforcement\n\nEducation and Training subject to the Administrative Procedures Act\n\nfor, but not limited to, the following reasons by clear and\n\nconvincing evidence:\n\n1. Falsification or a willful misrepresentation of information\n\nin an employment application, application to the Council on Law\n\nEnforcement Education and Training, records of evidence or in\n\ntestimony under oath;\n\n2. Failure to successfully complete any prescribed phase or\n\ncourse of training as required by the Council;\n\n3. Violation of any provision of the Bail Enforcement and\n\nLicensing Act or any rule promulgated pursuant thereto;\n\n4. A conviction, entry of a plea of guilty or nolo contendere\n\nor an \"Alford\" plea or any plea other than a not guilty plea for\n\nassault or battery, aggravated assault or battery, larceny, theft,\n\nfalse pretense, fraud, embezzlement, false personation of an\n\nofficer, any offense involving a minor as a victim, any\n\nnonconsensual sex offense, any offense involving the possession,\n\nuse, distribution, or sale of a controlled dangerous substance, any\n\noffense of driving while intoxicated or driving under the influence\n\nof intoxicating substance, any offense involving a firearm, any\n\nfelony or any other offense as proscribed by the Council;\n\n5. Use of beverages containing alcohol while armed with a\n\nfirearm;\n\n6. Knowingly impersonating a law enforcement officer;\n\n7. Improper use of force pursuant to the Bail Enforcement and\n\nLicensing Act;\n\n8. Failure to carry and possess proper license, identification\n\nor documents required by the Bail Enforcement and Licensing Act or\n\nany rules promulgated pursuant thereto;\n\n9. Improper apparel or vehicle pursuant to the Bail Enforcement\n\nand Licensing Act;\n\n10. Improper carry, display or use of a firearm, weapon or\n\nnoxious substance;\n\n11. Unlawful entry into a dwelling house, structure, property\n\nor vehicle or improper detention of any person;\n\n12. Employing, authorizing, or permitting an unlicensed person\n\nto perform or engage in services as a bail enforcer;\n\n13. Permitting a person to perform or engage in services as a\n\nbail enforcer knowing the person has committed any offense\n\nprohibited by the Bail Enforcement and Licensing Act;\n\n14. Revocation or voluntary surrender of police or peace\n\nofficer certification, private security guard license, private\n\ninvestigator license, or bail enforcer license in another state for\n\na violation of any law or rule or in settlement of any disciplinary\n\naction in such state; or\n\n15. If an applicant is the defendant in a criminal prosecution\n\nthat is pending, no license will be issued until final resolution of\n\nthe criminal prosecution. If an applicant is the subject of an\n\norder deferring imposition of judgment and sentence, no license will\n\nbe issued until completion of the deferred sentence and dismissal of\n\nthe criminal prosecution without a finding of guilt.\n\nB.
