A Board of Podiatric Medical Examiners is hereby re-created,\n\nto continue until July 1, 2027, in accordance with the provisions of\n\nthe Oklahoma Sunset Law. The Board shall regulate the practice of\n\npodiatric medicine in this state in accordance with the provisions\n\nof the Podiatric Medicine Practice Act. The Board, appointed by the\n\nGovernor, shall be composed of five podiatric physicians licensed to\n\npractice podiatric medicine in this state and one lay member\n\nrepresenting the public.\n\nB. Each podiatric physician member of the Board shall:\n\n1. Be a legal resident of this state;\n\n2. Have practiced podiatric medicine continuously in this state\n\nduring the three (3) years immediately preceding appointment to the\n\nBoard;\n\n3. Be free of pending disciplinary action or active\n\ninvestigation by the Board; and\n\n4. Be a member in good standing of the American Podiatric\n\nMedical Association and of the Oklahoma Podiatric Medical\n\nAssociation.\n\nC. The lay member of the Board shall:\n\n1. Be a legal resident of this state;\n\n2. Not be a registered or licensed practitioner of any of the\n\nhealing arts or be related, within the third degree of consanguinity\n\nor affinity, to any such person; and\n\n3. Participate in Board proceedings only for the purposes of:\n\na. reviewing, investigating and disposing of written\n\ncomplaints regarding the conduct of podiatric\n\nphysicians, and\n\nb. formulating, adopting and promulgating rules pursuant\n\nto Article I of the Administrative Procedures Act.\n\nD. Except as provided in subsection E of this section, the term\n\nof office of each podiatric physician member of the Board shall be\n\nfive (5) years, with one such member being appointed to the Board\n\neach year. The lay member of the Board shall serve a term\n\ncoterminous with that of the Governor. Each member shall hold\n\noffice until the expiration of the term for which appointed or until\n\na qualified successor has been duly appointed. An appointment shall\n\nbe made by the Governor within ninety (90) days after the expiration\n\nof the term of any member, or the occurrence of a vacancy on the\n\nBoard due to resignation, death, or any other cause resulting in an\n\nunexpired term. The appointment of the podiatric physician members\n\nshall be made from a list of not less than five persons submitted\n\nannually to the Governor by the Oklahoma Podiatric Medical\n\nAssociation.\n\nE. Each of the three podiatric physician members of the Board,\n\nserving on September 1, 1993, shall complete the term of office for\n\nwhich he or she was appointed, and the successor to each such member\n\nshall be appointed for a term of five (5) years. Within sixty (60)\n\ndays after September 1, 1993, the Governor shall appoint two new\n\npodiatric physician members to the Board, one for a term expiring\n\nJuly 1, 1997, and one for a term expiring on July 1, 1998. The\n\nsuccessor to each such new member shall be appointed for a term of\n\nfive (5) years.\n\nF. Before assuming duties on the Board, each member shall take\n\nand subscribe to the oath or affirmation provided in Article XV of\n\nthe Oklahoma Constitution, which oath or affirmation shall be\n\nadministered and filed as provided in such article.\n\nG. A member may be removed from the Board by the Governor for\n\ncause which shall include, but not be limited to:\n\n1. Ceasing to be qualified;\n\n2. Being found guilty by a court of competent jurisdiction of a\n\nfelony or of any offense involving moral turpitude;\n\n3. Being found guilty, through due process, of malfeasance,\n\nmisfeasance or nonfeasance in relation to Board duties;\n\n4. Being found mentally incompetent by a court of competent\n\njurisdiction;\n\n5. Being found in violation of any provision of the Podiatric\n\nMedicine Practice Act; or\n\n6.
