A licensed psychologist shall report to the Board\n\ninformation regarding a psychologist suspected of practicing\n\npsychology while being impaired or incapacitated by misuse of drugs,\n\nnarcotics, alcohol, chemicals, or as a result of any mental or\n\nphysical condition. Any person making a report to the Board under\n\nthis section shall be immune from any civil or criminal liability\n\nresulting from such reports, provided such reports are made in good\n\nfaith.\n\nB. The Board may defer disciplinary action under Section 1370\n\nof this title for an impaired psychologist who voluntarily signs an\n\nagreement, in a form satisfactory to the Board, agreeing to enter a\n\nBoard-approved treatment and monitoring program for impaired\n\npractitioners. The impaired psychologist shall consent, in\n\naccordance with applicable law, to the release of any treatment\n\ninformation to the Board from anyone within the approved treatment\n\nprogram.\n\nC. In the event the psychologist fails to comply with the\n\nagreement terms and make satisfactory progress in the treatment and\n\nmonitoring program, the Board shall suspend the license immediately\n\nand assign a hearing date for the matter to be presented to the\n\nBoard.\n\nD. Any person who enters into an agreement under this section\n\nshall be responsible for any and all costs associated with\n\nparticipation in the treatment program.\n\nE.
