The Board of Podiatric Medical Examiners is authorized,\n\nafter notice and opportunity for a hearing pursuant to Article II of\n\nthe Administrative Procedures Act, to issue an order imposing one or\n\nmore of the following penalties whenever the Board finds, by clear\n\nand convincing evidence, that a podiatric physician has committed\n\nany of the acts or occurrences set forth in Section 148 of this\n\ntitle:\n\n1. Disapproval of an application for a renewal license;\n\n2. Suspension of a license issued by the Board for a maximum\n\nperiod of three (3) years;\n\n3. Revocation of a license issued by the Board;\n\n4. An administrative fine not to exceed One Thousand Dollars\n\n($1,000.00) for each count or separate violation;\n\n5. A censure or reprimand;\n\n6. Placement on probation for a period of time and under such\n\nterms and conditions as deemed appropriate by the Board;\n\n7. Restriction of the practice of a podiatric physician under\n\nsuch terms and conditions as deemed appropriate by the Board; and\n\n8. Payment of costs associated with a disciplinary proceeding.\n\nB. The Board may, by rule, establish guidelines for the\n\ndisposition of disciplinary cases involving specific types of\n\nviolations. The guidelines may include:\n\n1. Minimum and maximum administrative fines;\n\n2. Periods of suspension, probation or supervision;\n\n3. Terms and conditions of probation; and\n\n4. Terms and conditions for the reinstatement of a license.\n\nC. The Board is authorized to issue a confidential letter of\n\nconcern to a podiatric physician when, though evidence does not\n\nwarrant initiation of an individual proceeding, the Board has noted\n\nindications of possible errant conduct by the podiatric physician\n\nthat could lead to serious consequences and formal action by the\n\nBoard.\n\nD.
