To exercise the Compact privilege under the terms and\n\nprovisions of the Compact, the audiologist or speech-language\n\npathologist shall:\n\n1. Hold an active license in the home state;\n\n2. Have no encumbrance on any state license;\n\n3. Be eligible for a compact privilege in any member state in\n\naccordance with Section 3 of this act;\n\n4. Have not had any adverse action against any license or\n\nCompact privilege within the previous two (2) years from date of\n\napplication;\n\n5. Notify the Commission that the licensee is seeking the\n\nCompact privilege within a remote state(s);\n\n6. Pay any applicable fees, including any state fee, for the\n\nCompact privilege; and\n\n7. Report to the Commission adverse action taken by any\n\nnonmember state within thirty (30) days from the date the adverse\n\naction is taken.\n\nB. For the purposes of the Compact privilege, an audiologist or\n\nspeech-language pathologist shall only hold one home state license\n\nat a time.\n\nC. Except as provided in Section 6 of this act, if an\n\naudiologist or speech-language pathologist changes primary state of\n\nresidence by moving between two member states, the audiologist or\n\nspeech-language pathologist shall apply for licensure in the new\n\nhome state, and the license issued by the prior home state shall be\n\ndeactivated in accordance with applicable rules adopted by the\n\nCommission.\n\nD. The audiologist or speech-language pathologist may apply for\n\nlicensure in advance of a change in primary state of residence.\n\nE. A license shall not be issued by the new home state until\n\nthe audiologist or speech-language pathologist provides satisfactory\n\nevidence of a change in primary state of residence to the new home\n\nstate and satisfies all applicable requirements to obtain a license\n\nfrom the new home state.\n\nF. If an audiologist or speech-language pathologist changes\n\nprimary state of residence by moving from a member state to a\n\nnonmember state, the license issued by the prior home state shall\n\nconvert to a single-state license, valid only in the former home\n\nstate.\n\nG. The compact privilege is valid until the expiration date of\n\nthe home state license. The licensee shall comply with the\n\nrequirements of subsection A of this section to maintain the Compact\n\nprivilege in the remote state.\n\nH. A licensee providing audiology or speech-language pathology\n\nservices in a remote state under the Compact privilege shall\n\nfunction within the laws and regulations of the remote state.\n\nI. A licensee providing audiology or speech-language pathology\n\nservices in a remote state is subject to that state's regulatory\n\nauthority. A remote state may, in accordance with due process and\n\nthat state's laws, remove a licensee's Compact privilege in the\n\nremote state for a specific period of time, impose fines and/or take\n\nany other necessary actions to protect the health and safety of its\n\ncitizens.\n\nJ. If a home state license is encumbered, the licensee shall\n\nlose the Compact privilege in any remote state until the following\n\noccur:\n\n1. The home state license is no longer encumbered; and\n\n2. Two (2) years have elapsed from the date of the adverse\n\naction.\n\nK. Once an encumbered license in the home state is restored to\n\ngood standing, the licensee shall meet the requirements of\n\nsubsection A of this section to obtain a Compact privilege in any\n\nremote state.\n\nL.
