Beginning January 1, 2005:\n\na. a person holding an original license and who is\n\nactively engaged in the practice of chiropractic in\n\nthis state shall pay to the Board of Chiropractic\n\nExaminers, on or before July 1 of each year, a renewal\n\nlicense fee of Two Hundred Seventy-five Dollars\n\n($275.00),\n\nb. an inactive nonresident holding an original license to\n\npractice chiropractic in Oklahoma and who has filed a\n\nstatement with the Board that the licensee is not\n\nactively engaged in the practice of chiropractic in\n\nthis state and shall not engage in the practice of\n\nchiropractic in this state during the succeeding year,\n\nshall pay to the Board, on or before July 1 of each\n\nyear, a renewal license fee of One Hundred Seventy-\n\nfive Dollars ($175.00),\n\nc. an inactive resident holding an original license to\n\npractice chiropractic in Oklahoma, and who has filed,\n\nor on whose behalf has been filed, a statement with\n\nthe Board that because of illness, infirmity, active\n\nmilitary service or other circumstances as approved by\n\nthe Board, the licensee is unable to actively engage\n\nin the practice of chiropractic during the succeeding\n\nyear, shall pay to the Board a renewal license fee of\n\nOne Hundred Dollars ($100.00), and\n\nd. a person holding an original license, but who is\n\nsixty-five (65) years of age or older and who has\n\nfiled a statement with the Board that the licensee is\n\nnot actively engaged in the practice of chiropractic\n\nin this state and shall not engage in the practice of\n\nchiropractic in this state during the succeeding year,\n\nshall pay to the Board a renewal licensee fee of Fifty\n\nDollars ($50.00).\n\n2. In addition, each licensee shall present to the Board\n\nsatisfactory evidence that during the preceding twelve (12) months\n\nthe licensee attended sixteen (16) hours of continuing education\n\nthat meets the requirements of Section 161.10a of this title,\n\nprovided that inactive resident licensees may, at the discretion of\n\nthe Board, be exempt from this requirement.\n\n3. Every chiropractic physician who is actively engaged in the\n\npractice of chiropractic in this state shall submit to the Board\n\ndocumentary evidence that the chiropractor has malpractice insurance\n\nand maintains such insurance twelve (12) months of each year when\n\npracticing in this state. Any licensee who is not actively engaged\n\nin practice in this state, shall be exempt from providing proof of\n\nmalpractice insurance.\n\nB. Subject to the laws of this state applicable to professional\n\nlicenses and rules promulgated pursuant to the Oklahoma Chiropractic\n\nPractice Act, the Board shall, upon determination that a licensee\n\nhas complied with the requirements of this section and the duly\n\npromulgated rules of the Board, issue a renewal license to the\n\nlicensee.\n\nC. The failure of a licensee to properly renew a license or\n\ncertificate shall be evidence of noncompliance with the Oklahoma\n\nChiropractic Practice Act.\n\n1. The license shall automatically be placed in a lapsed status\n\nfor failure to renew and shall be considered lapsed and not in good\n\nstanding for purposes of the practice of chiropractic.\n\n2. If within sixty (60) calendar days after July 1, the\n\nlicensee cures any renewal requirement deficiency, pays the renewal\n\nfee and pays a reinstatement fee set by the Board, the license may\n\nbe reactivated.\n\n3. If a license is not reactivated under this subsection within\n\nsixty (60) calendar days after July 1, the license shall\n\nautomatically be suspended for failure to renew.\n\n4. The practice of chiropractic is prohibited unless the\n\nlicense is active and in good standing with the Board.\n\nD. When an original license or renewal license, or both, have\n\nbeen suspended under the provisions of this section, the license or\n\nlicenses may be reinstated upon:\n\n1. Payment of a reinstatement fee in an amount fixed by the\nnse shall\n\nautomatically be suspended for failure to renew.\n\n4. The practice of chiropractic is prohibited unless the\n\nlicense is active and in good standing with the Board.\n\nD. When an original license or renewal license, or both, have\n\nbeen suspended under the provisions of this section, the license or\n\nlicenses may be reinstated upon:\n\n1. Payment of a reinstatement fee in an amount fixed by the\n\nBoard not to exceed Four Hundred Dollars ($400.00);\n\n2. Payment of the renewal license fee for the calendar year in\n\nwhich the original license is reinstated; and\n\n3. Presentation to the Board of satisfactory evidence of\n\ncompliance with the continuing education requirement of this section\n\nfor the calendar year in which the original license is reinstated.\n\nE. The Board, by rule, may establish guidelines for the\n\ndisposition of disciplinary cases involving specific types of\n\nviolations. The guidelines may include, but are not limited to:\n\n1. Minimum and maximum administrative fines;\n\n2. Periods of suspension, probation or supervision;\n\n3. Terms and conditions of probation; and\n\n4. Terms and conditions for the reinstatement of an original\n\nlicense or renewal license, or both.\n\nF. The license of a chiropractic physician who is not compliant\n\nwith Oklahoma income tax law pursuant to Section 238.1 of Title 68\n\nof the Oklahoma Statutes shall not be renewed. Such license shall\n\nbe automatically suspended as of July 1 of the renewal year and\n\nshall remain suspended until the Board receives notice from the\n\nOklahoma Tax Commission that the licensee has come into compliance\n\nwith Oklahoma income tax law.
