The Board of Chiropractic Examiners is authorized, after\n\nnotice and an opportunity for a hearing pursuant to Article II of\n\nthe Administrative Procedures Act, to issue an order imposing one or\n\nmore of the following penalties whenever the Board finds, by clear\n\nand convincing evidence, that a chiropractic physician has committed\n\nany of the acts or occurrences set forth in subsection B of this\n\nsection:\n\n1. Disapproval of an application for a renewal license;\n\n2. Revocation or suspension of an original license or renewal\n\nlicense, or both;\n\n3. Restriction of the practice of a chiropractic physician\n\nunder such terms and conditions as deemed appropriate by the Board;\n\n4. An administrative fine not to exceed One Thousand Dollars\n\n($1,000.00) for each count or separate violation;\n\n5. A censure or reprimand;\n\n6. Placement of a chiropractic physician on probation for a\n\nperiod of time and under such terms and conditions as the Board may\n\nspecify, including requiring the chiropractic physician to submit to\n\ntreatment, to attend continuing education courses, to submit to\n\nreexamination, or to work under the supervision of another\n\nchiropractic physician; and\n\n7. The assessment of costs expended by the Board in\n\ninvestigating and prosecuting a violation. The costs may include,\n\nbut are not limited to, staff time, salary and travel expenses,\n\nwitness fees and attorney fees, and shall be considered part of the\n\norder of the Board.\n\nB. The following acts or occurrences by a chiropractic\n\nphysician shall constitute grounds for which the penalties specified\n\nin subsection A of this section may be imposed by order of the\n\nBoard:\n\n1. Pleading guilty or nolo contendere to, or being convicted\n\nof, a felony, a misdemeanor involving moral turpitude, or a\n\nviolation of federal or state controlled dangerous substances laws.\n\nA copy of the judgment and sentence of the conviction, duly\n\ncertified by the clerk of the court in which the conviction was\n\nobtained, and a certificate of the clerk that the conviction has\n\nbecome final, shall be sufficient evidence for the imposition of a\n\npenalty;\n\n2. Being habitually drunk or habitually using habit-forming\n\ndrugs;\n\n3. Using advertising in which statements are made that are\n\nfraudulent, deceitful or misleading to the public;\n\n4. Aiding or abetting any person not licensed to practice\n\nchiropractic in this state to practice chiropractic, except students\n\nwho are regularly enrolled in an accredited chiropractic college;\n\n5. Performing or attempting to perform major or minor surgery\n\nin this state, or using electricity in any form for surgical\n\npurposes, including cauterization;\n\n6. Using or having in a chiropractic physician's possession any\n\ninstrument for treatment purposes, the use or possession of which\n\nhas been prohibited or declared unlawful by any agency of the United\n\nStates or the State of Oklahoma;\n\n7. Unlawfully possessing, prescribing or administering any\n\ndrug, medicine, serum or vaccine. This section shall not prevent a\n\nchiropractic physician from possessing, prescribing or\n\nadministering, by a needle or otherwise, vitamins, minerals or\n\nnutritional supplements, or from practicing within the scope of the\n\nscience and art of chiropractic as defined in Section 161.2 of this\n\ntitle;\n\n8. Advertising or displaying, directly or indirectly, any\n\ncertificate, diploma or other document which conveys or implies\n\ninformation that the person is skilled in any healing art other than\n\nchiropractic unless the chiropractic physician also possesses a\n\nvalid current license in said healing art;\n\n9. Obtaining an original license or renewal license in a\n\nfraudulent manner;\n\n10. Violating any provision of the Unfair Claims Settlement\n\nPractices Act or any rule promulgated pursuant thereto;\n\n11. Willfully aiding or assisting an insurer, as defined in\nctic physician also possesses a\n\nvalid current license in said healing art;\n\n9. Obtaining an original license or renewal license in a\n\nfraudulent manner;\n\n10. Violating any provision of the Unfair Claims Settlement\n\nPractices Act or any rule promulgated pursuant thereto;\n\n11. Willfully aiding or assisting an insurer, as defined in\n\nSection 1250.2 of Title 36 of the Oklahoma Statutes, or an\n\nadministrator, as defined in Section 1442 of Title 36 of the\n\nOklahoma Statutes, to deny claims which under the terms of the\n\ninsurance contract are covered services and are medically necessary;\n\n12. Violating any provision of the Oklahoma Chiropractic\n\nPractice Act; or\n\n13. Violating any of the rules of the Board.\n\nC. Any chiropractic physician against whom a penalty is imposed\n\nby an order of the Board under the provisions of this section shall\n\nhave the right to seek a judicial review of the order pursuant to\n\nArticle II of the Administrative Procedures Act.\n\nD. The Board is authorized to issue a confidential letter of\n\nconcern to a chiropractic physician when, though evidence does not\n\nwarrant initiation of an individual proceeding, the Board has noted\n\nindications of possible errant conduct by the chiropractic physician\n\nthat could lead to serious consequences and formal action by the\n\nBoard.\n\nE.
