A Board of Chiropractic Examiners is hereby re-created to\n\ncontinue until July 1, 2026, in accordance with the provisions of\n\nthe Oklahoma Sunset Law. The Board shall regulate the practice of\n\nchiropractic in this state in accordance with the provisions of the\n\nOklahoma Chiropractic Practice Act. The Board, appointed by the\n\nGovernor, shall be composed of eight chiropractic physicians and one\n\nlay member representing the public.\n\nB. Each chiropractic physician member of the Board shall:\n\n1. Be a legal resident of this state;\n\n2. Have practiced chiropractic continuously in this state\n\nduring the five (5) years immediately preceding appointment to the\n\nBoard;\n\n3. Be free of pending disciplinary action or active\n\ninvestigation by the Board;\n\n4. Be a person of recognized professional ability, integrity\n\nand good reputation; and\n\n5. Be in active clinical chiropractic practice at least fifty\n\npercent (50%) of the time.\n\nC. The lay member of the Board shall:\n\n1. Be a legal resident of this state; and\n\n2. Not be a registered or licensed practitioner of any of the\n\nhealing arts or be related within the third degree of consanguinity\n\nor affinity to any such person.\n\nD. The Governor shall appoint members to the Board and for\n\nterms of years as follows:\n\n1. Position 1: Upon expiration of the term of the board member\n\nwhose term expires November 2, 2006, the Governor shall appoint a\n\nboard member from District 1 for a term of four (4) years to expire\n\non November 1, 2010, and every four (4) years thereafter;\n\n2. Position 2: Upon expiration of the term of the board member\n\nwhose term expires November 1, 2005, the Governor shall appoint a\n\nboard member from District 2 for a term of four (4) years to expire\n\non November 1, 2009, and every four (4) years thereafter;\n\n3. Position 3: Upon expiration of the term of the board member\n\nwhose term expires June 7, 2007, the Governor shall appoint a board\n\nmember from District 3 for a term of four (4) years to expire on\n\nJune 1, 2011, and every four (4) years thereafter;\n\n4. Position 4: Upon expiration of the term of the board member\n\nwhose term expires November 1, 2007, the Governor shall appoint a\n\nboard member from District 4 for a term of four (4) years to expire\n\non November 1, 2011, and every four (4) years thereafter;\n\n5. Position 5: Upon expiration of the term of the board member\n\nwhose term expires June 7, 2008, the Governor shall appoint a board\n\nmember from District 5 for a term of four (4) years to expire on\n\nJune 1, 2012, and every four (4) years thereafter;\n\n6. Position 6: On June 1, 2005, the Governor shall appoint a\n\nboard member from District 6 for a term of one (1) year to expire on\n\nJune 1, 2006, and every four (4) years thereafter;\n\n7. Position 7: On November 1, 2005, the Governor shall appoint\n\na board member from District 7 for a term of three (3) years to\n\nexpire on November 1, 2008, and every four (4) years thereafter;\n\n8. Position 8: Upon expiration of the term of the board member\n\nwhose term expires June 7, 2005, the Governor shall appoint a board\n\nmember from the state at large for a term of four (4) years to\n\nexpire on June 1, 2009, and every four (4) years thereafter; and\n\n9. Position 9: The lay member of the Board shall serve a term\n\ncoterminous with that of the Governor.\n\nE. For the purpose of the Oklahoma Chiropractic Practice Act,\n\nthe state shall be divided into the following districts:\n\n1. District 1: Alfalfa, Beaver, Beckham, Caddo, Cimarron,\n\nCuster, Dewey, Ellis, Grant, Greer, Garfield, Harmon, Harper,\n\nJackson, Kiowa, Major, Noble, Roger Mills, Texas, Washita, Woods and\n\nWoodward Counties;\n\n2. District 2: Tulsa County;\n\n3. District 3: Kay, Logan, Lincoln, Osage, Pawnee, Payne and\n\nPottawatomie Counties;\n\n4. District 4: Carter, Comanche, Cotton, Garvin, Grady, Love,\n\nMurray, Jefferson, Stephens and Tillman Counties;\nmon, Harper,\n\nJackson, Kiowa, Major, Noble, Roger Mills, Texas, Washita, Woods and\n\nWoodward Counties;\n\n2. District 2: Tulsa County;\n\n3. District 3: Kay, Logan, Lincoln, Osage, Pawnee, Payne and\n\nPottawatomie Counties;\n\n4. District 4: Carter, Comanche, Cotton, Garvin, Grady, Love,\n\nMurray, Jefferson, Stephens and Tillman Counties;\n\n5. District 5: Blaine, Canadian, Cleveland, Kingfisher,\n\nMcClain and Oklahoma Counties;\n\n6. District 6: Atoka, Bryan, Coal, Choctaw, Creek, Hughes,\n\nJohnston, Latimer, Le Flore, Marshall, McCurtain, Okfuskee,\n\nPittsburg, Pontotoc, Pushmataha and Seminole Counties; and\n\n7. District 7: Adair, Cherokee, Craig, Delaware, Haskell,\n\nMayes, McIntosh, Muskogee, Nowata, Okmulgee, Ottawa, Rogers,\n\nSequoyah, Wagoner and Washington Counties.\n\nMembers appointed after June 2002 shall serve no more than two (2)\n\nconsecutive terms.\n\nF. Each member shall hold office until the expiration of the\n\nterm of office for which appointed or until a qualified successor\n\nhas been duly appointed. An appointment shall be made by the\n\nGovernor within ninety (90) days after the expiration of the term of\n\nany member, or the occurrence of a vacancy on the Board due to\n\nresignation, death, or any other cause resulting in an unexpired\n\nterm.\n\nG. Before assuming duties on the Board, each member shall take\n\nand subscribe to the oath or affirmation provided in Article XV of\n\nthe Oklahoma Constitution, which oath or affirmation shall be\n\nadministered and filed as provided in the article.\n\nH. A member may be removed from the Board by the Governor for\n\ncause which shall include, but not be limited to:\n\n1. Ceasing to be qualified;\n\n2. Being found guilty by a court of competent jurisdiction of a\n\nfelony or any offense involving moral turpitude;\n\n3. Being found guilty, through due process, of malfeasance,\n\nmisfeasance or nonfeasance in relation to Board duties;\n\n4. Being found mentally incompetent by a court of competent\n\njurisdiction;\n\n5. Being found in violation of any provision of the Oklahoma\n\nChiropractic Practice Act; or\n\n6. Failing to attend three meetings of the Board without just\n\ncause, as determined by the Board.\n\nI. No member of the Board shall be:\n\n1. A registered lobbyist;\n\n2. An officer, board member or employee of a statewide\n\norganization established for the purpose of advocating the interests\n\nof chiropractors licensed pursuant to the Oklahoma Chiropractic\n\nPractice Act; or\n\n3.
