Stat. tit. 59, § 59-1634","heading":"Adoption of American Society of Mechanical Engineers","body":"Codes - Certification of welders - Penalties.\n\nA. The following American Society of Mechanical Engineers\n\nCodes, based upon the latest edition, shall be the piping codes for\n\nthis state:\n\n1. The power piping code, ASME B31.1;\n\n2. The fuel gas piping code, ASME B31.2;\n\n3. The gas transmission and distribution piping system code,\n\nASME B31.8;\n\n4. The process piping code, ASME B31.3; and\n\n5. The liquid transportation systems for hydrocarbons, liquid\n\npetroleum gas, anhydrous ammonia and alcohols code, ASME 31.4.\n\nB. The American Welding Society D1.1 and D1.3 shall be the\n\nstructural steel welding codes for this state.\n\nC. The provisions of this act shall apply only to weldments\n\nrequired by the above codes.\n\nD. All welders prior to performing weldments within this state\n\non any piping enumerated in subsection A of this section or\n\nstructural steel welding enumerated in subsection B of this section\n\nshall be tested, qualified and certified by the Commissioner of\n\nLabor pursuant to this act.\n\nE. It shall be mandatory upon the owner, or a contractor to\n\nwhom a contract is awarded and upon any welders wherein welders are\n\nto perform weldments on any piping enumerated in subsection A, upon\n\nany subcontractor under the owner or a contractor, to ensure that\n\nall welders performing weldments within this state shall be\n\ncertified by the Commissioner of Labor before any weldments are\n\nfabricated.\n\nF. Penalties:\n\n1. Any welder who violates or omits to comply with any of the\n\nprovisions of this section, and any officer, agent or representative\n\nof any owner or any contractor or subcontractor who violates or\n\nomits to comply with any of the provisions of this section shall be\n\nsubjected to the penalties provided in this title.\n\n2. The Commissioner of Labor is empowered to issue cease and\n\ndesist orders against violations of this act until such time as\n\ncompliance of the law is met. If an owner, welder, contractor\n\nand/or subcontractor fails to obey the orders issued by the\n\nCommissioner of Labor, the Attorney General shall review the case\n\nand initiate necessary proceedings for contempt of the\n\nCommissioner's order and/or ask for an injunction in the district\n\ncourt as deemed appropriate to the facts of the case.\n\n3. No person, firm or corporation or agent thereof shall in any\n\nmanner interfere with the performance of the duties of any inspector\n\nor representative of the Commissioner of Labor for the\n\nimplementation of this act.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7003743104af3839966f243fb3900b80da2ba044861b571a5ce7594e08a34914","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1633","next":"us-ok/okla.-stat.-tit.-59-59-1634.1"},"notice":"GroundRules: Original legal text.
