The Construction Industries Board is hereby authorized to\n\nestablish a license category for contractors who solely perform\n\npoultry house premise wiring for environmentally controlled poultry\n\nhouse systems, and the insured poultry house wiring to connect the\n\npremise wiring, and who do not perform any wiring for a structure or\n\nelectrical facility that is not directly involved in the operation\n\nof the environmentally controlled poultry house wiring system. In\n\naddition to other statutory authority, the Construction Industries\n\nBoard shall have the power to exercise all incidental powers and\n\nduties necessary to effectuate the provisions of the poultry house\n\ncontractor license, conduct investigations involving compliance with\n\nthe licensing requirements, and enforce the licensing provisions of\n\nthis section. However, the Construction Industries Board is not\n\nauthorized to conduct an electrical code inspection of an\n\nenvironmentally controlled poultry house premise wiring system for\n\npurposes of compliance with electrical code installation standards\n\nestablished for the Electrical License Act or to issue\n\nadministrative citations or fines concerning electrical code\n\ninstallation standards at an environmentally controlled poultry\n\nhouse.\n\n1. With a valid poultry house contractor license, no further\n\nregistration or license is required under this act in order to\n\nsolely perform poultry house wiring for environmentally controlled\n\npoultry houses. This license allows contracting only for wiring of\n\nenvironmentally controlled poultry house systems and is not intended\n\nto disallow or exclude unlimited electrical contractors from\n\nperforming poultry house wiring work under an unlimited electrical\n\ncontractor license without a poultry house contractor license.\n\n2. Experience under the poultry house contractor license shall\n\nnot be considered qualifying electrical experience for purposes of\n\nexperience requirements for application of any other electrical\n\nlicense category pursuant to the Electrical License Act.\n\n3. The Board may rely upon proof of a valid construction\n\nlicense or registration issued by another state to expedite the\n\nprocessing of the required information for a poultry house\n\ncontractor license; provided, the insurance and workers'\n\ncompensation requirements demonstrate compliance with the required\n\ncoverage for work performed in this state.\n\n4. All licenses shall be nontransferable, and it shall be a\n\nmisdemeanor for any business entity holding a poultry house\n\ncontractor license under the provisions of the Electrical License\n\nAct to loan or allow the use of such license by any other person,\n\nfirm or corporation, except as specifically provided in the\n\nElectrical License Act or to engage in poultry house contractor\n\nlicense work without a valid license pursuant to this act.\n\nB. A nonrefundable fee in the amount of Three Hundred Dollars\n\n($300.00) for the annual poultry house contractor license shall be\n\npaid at the time of license application to the Construction\n\nIndustries Board. The annual license shall expire one (1) year from\n\nthe date of issuance. A poultry house contractor license shall be\n\nissued for one year, at which time it may be renewed upon meeting\n\nthe requirements of this section, making application, and paying the\n\nnonrefundable license renewal fee in the amount of Two Hundred\n\nDollars ($200.00).\n\nC. The Construction Industries Board shall, upon proper\n\napplication and payment of fee, license and issue a certificate of\n\npoultry house contractor license to any person who furnishes\n\nsatisfactory proof to the Board that the applicant:\n\n1. Is eighteen (18) years of age or over;\n\n2. Is the party performing, overseeing or otherwise responsible\n\nfor the poultry house contractor work performed and who meets all\n\nrequirements of this act and resulting rules required to obtain such\n\nlicense; and\nand issue a certificate of\n\npoultry house contractor license to any person who furnishes\n\nsatisfactory proof to the Board that the applicant:\n\n1. Is eighteen (18) years of age or over;\n\n2. Is the party performing, overseeing or otherwise responsible\n\nfor the poultry house contractor work performed and who meets all\n\nrequirements of this act and resulting rules required to obtain such\n\nlicense; and\n\n3. Has provided all necessary information and documentation\n\nrequired under this act, the resulting rules, and as requested by\n\nthe Board.\n\nD. The Construction Industries Board shall require the\n\nfollowing for a poultry house contractor license:\n\n1. The applicant's full legal name, physical address, mailing\n\naddress, business name, telephone number of business and applicant,\n\naddress and place of incorporation, if any, and address of legal\n\nregistered service agent in this state;\n\n2. Proof of lawful presence in the United States for the\n\napplicant and all employees and laborers working under the applicant\n\nin this state who will be involved in wiring a poultry house for\n\nenvironmentally controlled poultry houses;\n\n3. A listing of the names and social security numbers of all\n\nemployees and laborers working in this state who will be involved in\n\nwiring a poultry house for environmentally controlled poultry\n\nhouses. The social security number information shall remain with\n\nthe Board as confidential and privileged except for necessary\n\ndisclosures to state agencies to verify compliance with requirements\n\nof this act or upon request by law enforcement;\n\n4. The business entity's federal tax ID number or the\n\nemployer's or owner's social security number. The employer's\n\naccount number assigned by the Employment Security Commission. The\n\nsocial security number information shall remain with the Board as\n\nconfidential and privileged except for necessary disclosures to\n\nstate agencies to verify compliance with requirements of this act or\n\nupon request by law enforcement;\n\n5. A letter of good standing from the Secretary of State in the\n\nstate the contractor is domiciled and other documentation of valid\n\nlicense or registration from the domicile state licensing or\n\nregistration board, commission or agency;\n\n6. Disclosure of resident or nonresident contractor status, and\n\nstate of residence and domicile;\n\n7. A copy of the applicant's certificate of liability insurance\n\nshall be filed with the application and shall be not less than Five\n\nHundred Thousand Dollars ($500,000.00). Any insurance company\n\nissuing a liability policy to an applicant pursuant to the\n\nprovisions of the poultry house contractor license under this act\n\nshall be required to notify the Construction Industries Board in the\n\nevent such liability policy is cancelled for any reason or lapses\n\nfor nonpayment of premiums. All licenses granted under this act\n\nshall be suspended on the date of the policy cancellation. The\n\nBoard must receive proof of insurance prior to reinstating the\n\nlicense;\n\n8. The applicant shall submit proof of satisfactory workers'\n\ncompensation coverage under the Workers' Compensation Act or an\n\naffidavit of exemption or self-insurance as authorized pursuant to\n\nthe Workers' Compensation Act;\n\n9. Disclosure of any felony convictions; and\n\n10. Applicants for poultry house contractor license shall\n\nprovide such additional documents, statements or other information\n\nas may be deemed appropriate or necessary and required by the Board.\n\nE. The Construction Industries Board shall refuse to license\n\nany person if the Board determines:\n\n1. The application contains false, misleading or incomplete\n\ninformation;\n\n2. The applicant or any member of the business entity fails or\n\nrefuses to provide any information requested by the Board;\n\n3. The applicant fails or refuses to pay the required fees;\n\n4. The applicant or owner or officer or managing member of the\nndustries Board shall refuse to license\n\nany person if the Board determines:\n\n1. The application contains false, misleading or incomplete\n\ninformation;\n\n2. The applicant or any member of the business entity fails or\n\nrefuses to provide any information requested by the Board;\n\n3. The applicant fails or refuses to pay the required fees;\n\n4. The applicant or owner or officer or managing member of the\n\nlegal entity is ineligible for license due to a suspended or revoked\n\nlicense or registration in this state;\n\n5. The nonresident applicant has a revoked or suspended\n\nregistration or license required by law for contractors in another\n\nstate; or\n\n6. The applicant or legal entity has failed or refuses to\n\nsubmit any taxes due in this state.\n\nF. The Board shall suspend the poultry house contractor license\n\nwhen the licensee fails to:\n\n1. Maintain liability insurance coverage;\n\n2. Maintain satisfactory workers' compensation coverage under\n\nthe Workers' Compensation Act or provide an affidavit of exemption\n\nor self-insurance as authorized pursuant to the Workers'\n\nCompensation Act;\n\n3. Comply with provisions of the Electrical License Act or any\n\nrule or order issued pursuant thereto;\n\n4. Perform normal business obligations without justifiable\n\ncause;\n\n5. Notify the Board of a change in name, address, legal\n\nbusiness entity, legal service agent, adverse finding by a licensing\n\nentity in this state or another state or adjudication by a court of\n\ncompetent jurisdiction for any act or omission that is a violation\n\nof the Electrical License Act;\n\n6. Maintain a registration or license as required by law in\n\nanother state while licensed in this state as a nonresident\n\ncontractor; or\n\n7.
