Stat. tit. 59, § 59-1689","heading":"Electrical Hearing Board - Investigations - Revocation or","body":"suspension of licenses - Jurisdiction of political subdivisions.\n\nA. The Construction Industries Board or its designee and the\n\nCommittee of Electrical Examiners shall act as the Electrical\n\nHearing Board and shall comply with the provisions of Article II of\n\nthe Administrative Procedures Act, Section 308a et seq. of Title 75\n\nof the Oklahoma Statutes.\n\nB. Any administrative hearing on suspensions, revocations or\n\nfines shall be conducted by a hearing examiner appointed by the\n\nBoard. The hearing examiner’s decision shall be a final decision\n\nwhich may be appealed to a district court in accordance with the\n\nAdministrative Procedures Act.\n\nC. The Electrical Hearing Board may, upon its own motion, and\n\nshall, upon written complaint filed by any person, investigate the\n\nbusiness transactions of any electrical contractor, journeyman\n\nelectrician, electrical apprentice, student apprentice or poultry\n\nhouse contractor license. Upon a finding by clear and convincing\n\nevidence, the Board shall suspend or revoke any license or\n\nregistration obtained by false or fraudulent representation. Upon a\n\nfinding by clear and convincing evidence, the Board shall also\n\nsuspend or revoke any license or registration for any of the\n\nfollowing:\n\n1. Making a material misstatement in the application for a\n\nlicense or registration, or the renewal of a license or\n\nregistration;\n\n2. Loaning or illegally using a license;\n\n3. Demonstrating incompetence to act as a journeyman\n\nelectrician or electrical contractor;\n\n4. Violating any provisions of the Electrical License Act, or\n\nany rule or order prescribed by the Board or any ordinance for the\n\ninstallation of electrical facilities made or enacted by a city or\n\ntown by authority of the Electrical License Act;\n\n5. Willfully failing to perform normal business obligations\n\nwithout justifiable cause; or\n\n6. Failing to maintain a registration or license as required by\n\nlaw in another state while registered in this state as a nonresident\n\ncontractor.\n\nD. Any person whose license or registration has been revoked by\n\nthe Electrical Hearing Board may apply for a new license one (1)\n\nyear from the date of such revocation.\n\nE. Notwithstanding any other provision of law, a political\n\nsubdivision of this state that has adopted a nationally recognized\n\nelectrical code and appointed an inspector pursuant to the\n\nprovisions of Section 1693 of this title or pursuant to the\n\nprovisions of the Oklahoma Inspectors Act for such work shall have\n\njurisdiction over the interpretation of the code and the\n\ninstallation of all electrical work done in that political\n\nsubdivision, subject to the provisions of the Oklahoma Inspectors\n\nAct. Provided, a state inspector may work directly with an\n\nelectrical contractor, journeyman electrician, electrical apprentice\n\nor student apprentice in such a locality if a violation of the code\n\ncreates an immediate threat to life or health.\n\nF. In the case of a complaint about, investigation of or\n\ninspection of any license, registration, permit or electrical work\n\nin any political subdivision of this state which has not adopted a\n\nnationally recognized electrical code and appointed an inspector\n\npursuant to the provisions of Section 1693 of this title or pursuant\n\nto the provisions of the Oklahoma Inspectors Act for such work, the\n\nConstruction Industries Board shall have jurisdiction over such\n\nmatters.\n\nG. 1. No individual, business, company, corporation,\n\nassociation or other entity subject to the provisions of the\n\nElectrical License Act shall install, modify or alter electrical\n\nfacilities in any incorporated area of this state which has not\n\nadopted a nationally recognized electrical code and appointed an\n\ninspector pursuant to the provisions of Section 1693 of this title\n\nor pursuant to the provisions of the Oklahoma Inspectors Act for\n\nsuch work without providing notice of such electrical work to the\nhe\n\nElectrical License Act shall install, modify or alter electrical\n\nfacilities in any incorporated area of this state which has not\n\nadopted a nationally recognized electrical code and appointed an\n\ninspector pursuant to the provisions of Section 1693 of this title\n\nor pursuant to the provisions of the Oklahoma Inspectors Act for\n\nsuch work without providing notice of such electrical work to the\n\nConstruction Industries Board. A notice form for reproduction by an\n\nindividual or entity required to make such notice shall be provided\n\nby the Construction Industries Board upon request.\n\n2. Notice to the Construction Industries Board pursuant to this\n\nsubsection shall not be required for electrical maintenance or\n\nreplacement of existing electrical appliances or fixtures or of any\n\npetroleum refinery or its research facilities.\n\n3.
