The Board may adopt rules which may be necessary for the\n\nperformance of its duties pursuant to the provisions of the Licensed\n\nDietitian Act.\n\nB. It shall be the duty of the Board, aided by the Committee,\n\nto pass upon the qualifications of applicants for licensure, to\n\nconduct all examinations and to determine which applicants\n\nsuccessfully pass such examinations.\n\nC. The Board shall:\n\n1. adopt an official seal;\n\n2. establish the qualifications and fitness of applicants for\n\nlicenses, renewal of licenses, and reciprocal licenses;\n\n3. revoke, suspend, or deny a license, probate a license\n\nsuspension, or reprimand a licensee for a violation of the Licensed\n\nDietitian Act, or the rules of the Board;\n\n4. spend funds necessary for the proper administration of its\n\nassigned duties;\n\n5. establish reasonable and necessary fees for the\n\nadministration and implementation of the Licensed Dietitian Act;\n\n6. maintain a record listing the name of every licensed\n\ndietitian in this state, his or her last-known place of business and\n\nlast-known place of residence, and the date and number of his or her\n\nlicense. The Board shall compile a list of dietitians licensed to\n\npractice in this state and such list shall be available to any\n\nperson upon application to the Board and the payment of such charge\n\nas may be fixed by the Board for such list;\n\n7. comply with the Oklahoma Open Meeting Law.\n\nD. The Board shall not adopt rules restricting competitive\n\nbidding or advertising by a person regulated by the Board except to\n\nprohibit false, misleading, or deceptive practices. The Board shall\n\nnot include in its rules to prohibit false, misleading, or deceptive\n\npractices by a person regulated by the Board a rule that:\n\n1. restricts the person's use of any medium for advertising; or\n\n2. restricts the person's personal appearance or use of his or\n\nher personal voice in an advertisement; or\n\n3. relates to the size or duration of any advertisement by the\n\nperson; or\n\n4. restricts the person's advertisement under a trade name.\n\nE. The State Board of Medical Licensure is authorized to obtain\n\na national criminal history background check as a condition of\n\neligibility for individuals applying to become a Licensed Dietitian.\n\n1. Applicants shall be fingerprinted for the national criminal\n\nhistory background check. Applicant fingerprints shall be submitted\n\nto the Oklahoma State Bureau of Investigation and the national\n\ncriminal history background check shall be conducted in accordance\n\nwith Section 150.9 of Title 74 of the Oklahoma Statutes. The Bureau\n\nshall return national criminal history results to the Board.\n\n2. Results obtained from the national criminal history\n\nbackground check shall be used solely for the screening of\n\napplicants and shall be retained by the Board.
