Stat. tit. 59, § 59-1750.2","heading":"Definitions","body":"As used in the Oklahoma Security Guard and Private Investigator\n\nAct:\n\n1. \"Client\" means any person or legal entity having a contract\n\nwith a person or entity licensed pursuant to the Oklahoma Security\n\nGuard and Private Investigator Act, which contract authorizes\n\nservices to be performed in return for financial or other\n\nconsiderations;\n\n2. \"Council\" means the Council on Law Enforcement Education and\n\nTraining;\n\n3. \"License\" means authorization issued by the Council pursuant\n\nto the Oklahoma Security Guard and Private Investigator Act\n\npermitting the holder to perform the functions of a security guard,\n\narmed security guard, private investigator, investigative agency, or\n\nsecurity agency;\n\n4. \"Private investigator\" means a person who is self-employed,\n\nor contracts with, or is employed by an investigative agency for the\n\npurpose of conducting a private investigation and reporting the\n\nresults to the employer or client of the employer relating to:\n\na. potential or pending litigation, civil or criminal,\n\nb. divorce or other domestic investigations,\n\nc. missing persons or missing property, or\n\nd. other lawful investigations, but shall not include:\n\n(1) a person authorized or employed by the United\n\nStates government, any state government, or any\n\nagency, department, or political subdivision\n\nthereof while engaged in the performance of\n\nofficial duties,\n\n(2) a person or employee of a firm, corporation or\n\nother legal entity engaged exclusively in a\n\nprofession licensed by any board, commission,\n\ndepartment or court of this state, or\n\n(3) a bona fide, salaried, full-time employee of a\n\nfirm, corporation or other legal entity not in\n\nthe primary business of soliciting and providing\n\nprivate investigations, who conducts\n\ninvestigations that are exclusive to and\n\nincidental to the primary business of said firm,\n\ncorporation or entity, and when the costs of such\n\ninvestigations are not charged directly back to\n\nthe particular client or customer who directly\n\nbenefits from the investigation;\n\n5. \"Armed private investigator\" means a private investigator\n\nauthorized to carry a firearm;\n\n6. \"Security agency\" means a person, firm, corporation, or\n\nother private legal entity in the business of security guard\n\nservices or armed security guards for hire;\n\n7. \"Security guard\" means an individual contracting with or\n\nemployed by a security agency, private business or person to prevent\n\ntrespass, theft, misappropriation, wrongful concealment of\n\nmerchandise, goods, money or other tangible items, or engaged as a\n\nbodyguard or as a private watchman to protect persons or property,\n\nbut shall not include:\n\na. for individuals operating unarmed, any person employed\n\nas a private watchman or security guard by one\n\nemployer only in connection with the affairs of such\n\nemployer where there exists an employer-employee\n\nrelationship,\n\nb. a full-time or active reserve certified peace officer\n\nof the United States, this state, or any political\n\nsubdivision of either:\n\n(1) while such peace officer is engaged in the\n\nperformance of his or her official duties within\n\nthe course and scope of his or her employment\n\nwith the United States, this state, or any\n\npolitical subdivision of either,\n\n(2) while such peace officer is engaged in the\n\nperformance of his or her duties as a railroad\n\npolice officer,\n\n(3) who receives compensation for private employment\n\non an individual or an individual independent\n\ncontractual basis as a patrolman, guard, or\n\nwatchman if such person is employed in an\n\nemployer-employee relationship or is employed on\n\nan individual contractual basis, or\nof either,\n\n(2) while such peace officer is engaged in the\n\nperformance of his or her duties as a railroad\n\npolice officer,\n\n(3) who receives compensation for private employment\n\non an individual or an individual independent\n\ncontractual basis as a patrolman, guard, or\n\nwatchman if such person is employed in an\n\nemployer-employee relationship or is employed on\n\nan individual contractual basis, or\n\n(4) who receives compensation from an employer-\n\nemployee relationship or an individual\n\nindependent contractor basis with any licensed\n\nsecurity agency as defined in this section or any\n\nprivate business or person to perform security or\n\ninvestigative services,\n\nc. any person whose terms of employment as a security\n\nguard are governed by a collective bargaining\n\nagreement on May 9, 1989, and\n\nd. any person who is employed as a full-time security\n\nguard by a financial institution on May 9, 1989;\n\n8. \"Armed security guard\" means a security guard authorized to\n\ncarry a firearm;\n\n9. \"Investigative agency\" means a self-employed private\n\ninvestigator, a firm, a corporation, or other private legal entity\n\nin the business of soliciting the business of private investigation\n\nand/or providing private investigations and investigators;\n\n10. \"Special event\" means a public activity in the form of an\n\nathletic contest, charity event, exposition or similar event that\n\noccurs only on an annual or noncontinuing basis; and\n\n11. \"Special event license\" means a temporary license issued\n\npursuant to the Oklahoma Security Guard and Private Investigator Act\n\nwhich restricts the license holder to employment as a security guard\n\nonly for the duration of a particular event.","path":["OK Code","Title
