Application for a license shall be made on forms\n\nprovided by the Council on Law Enforcement Education and Training\n\nand shall be submitted in writing by the applicant under oath. The\n\napplication shall require the applicant to furnish information\n\nreasonably required by the Council to implement the provisions of\n\nthe Oklahoma Security Guard and Private Investigator Act, including\n\nclassifiable fingerprints to enable the search of criminal indices\n\nfor evidence of a prior criminal record, including, but not limited\n\nto, a national criminal history record check as defined by Section\n\n150.9 of Title 74 of the Oklahoma Statutes.\n\n2. Upon request of the Council, the Oklahoma State Bureau of\n\nInvestigation and other state and local law enforcement agencies\n\nshall furnish a copy of any existent criminal history data relating\n\nto an applicant, including investigation reports which are otherwise\n\nrequired by law to be deemed confidential, to enable the Council to\n\ndetermine the qualifications and fitness of such applicant for a\n\nlicense.\n\n3. A retired peace officer applying for an armed security guard\n\nlicense or armed private investigator license or a combination\n\nthereof shall not be required to provide a set of classifiable\n\nfingerprints to the Council and shall be exempt from the provisions\n\nof paragraph 2 of this subsection upon submitting to the Council a\n\nnotarized letter confirming that the peace officer retired in good\n\nstanding from a law enforcement agency within this state.\n\nB. 1. a. An original application and any license renewal shall\n\nbe accompanied by a fee of Fifty Dollars ($50.00) for\n\neach original application and renewal of a private\n\ninvestigator or an unarmed security guard, One Hundred\n\nDollars ($100.00) for each original application and\n\nrenewal of an armed security guard or an armed private\n\ninvestigator; provided however, an active certified\n\npeace officer upon application or renewal of an armed\n\nsecurity guard or armed private investigator shall be\n\ncharged only twenty percent (20%) of the required fee,\n\nSeven Dollars ($7.00) for each special event license,\n\nand Three Hundred Dollars ($300.00) for either the\n\noriginal application or each renewal for a security\n\nagency or investigative agency. If an individual or\n\nagency does not qualify for the type of license or\n\nrenewal license requested, CLEET shall retain twenty\n\npercent (20%) of the licensing fee as a processing fee\n\nand refund the remaining amount, if any, to the\n\nremitter. The individual license fee paid by a\n\nlicensed agency will be refunded to the agency.\n\nb. In addition to the fees provided in this subsection,\n\nthe original application of an unarmed private\n\ninvestigator, unarmed security guard, armed security\n\nguard or armed private investigator shall be\n\naccompanied by a nonrefundable fee for a national\n\ncriminal history record with fingerprint analysis, as\n\nprovided in Section 150.9 of Title 74 of the Oklahoma\n\nStatutes.\n\nc. A refund request for any reason other than\n\ndisqualification or denial shall be made in writing\n\nand submitted within six (6) months of the date\n\npayment was received.\n\n2. A licensee whose license has been suspended may apply for\n\nreinstatement of license after the term of the suspension has\n\npassed. Any application for reinstatement following a suspension of\n\nlicensure shall be accompanied by a nonrefundable fee of Twenty-five\n\nDollars ($25.00) for the reinstatement of a private investigator or\n\nunarmed security guard, Fifty Dollars ($50.00) for the reinstatement\n\nof an armed security guard or armed private investigator, and Two\n\nHundred Dollars ($200.00) for reinstatement of a security or\n\ninvestigative agency.\n\n3. A licensee who fails to file a renewal application on or\nccompanied by a nonrefundable fee of Twenty-five\n\nDollars ($25.00) for the reinstatement of a private investigator or\n\nunarmed security guard, Fifty Dollars ($50.00) for the reinstatement\n\nof an armed security guard or armed private investigator, and Two\n\nHundred Dollars ($200.00) for reinstatement of a security or\n\ninvestigative agency.\n\n3. A licensee who fails to file a renewal application on or\n\nbefore the expiration of a license shall pay a non-refundable late\n\nfee of Twenty-five Dollars ($25.00) for an individual license and a\n\nlate fee of One Hundred Dollars ($100.00) for an agency license. A\n\nlicense application received more than thirty (30) days after the\n\nexpiration date is not renewable and the applicant must complete a\n\nnew application.\n\n4. The fees charged and collected pursuant to the provisions of\n\nthis subsection shall be deposited to the credit of the CLEET\n\nPrivate Security Revolving Fund. The prevailing fingerprint\n\nprocessing fee for the original application for a private\n\ninvestigator, an unarmed security guard, an armed security guard or\n\nan armed private investigator shall be deposited in the OSBI\n\nRevolving Fund.\n\nC. A Security Guard License, Armed Security Guard License,\n\nPrivate Investigator License, or Armed Private Investigator License\n\nshall be valid for a period of three (3) years and may be renewed\n\nfor additional three-year terms. A Security Agency License or\n\nInvestigative Agency License shall be valid for a period of five (5)\n\nyears and may be renewed for additional five-year terms. A special\n\nevent license shall be valid only for the duration of the event for\n\nwhich it is expressly issued. Any individual may be issued up to\n\ntwo special event licenses during any calendar year.\n\nD. The Council shall devise a system for issuance of licenses\n\nfor the purpose of evenly distributing the expiration dates of the\n\nlicenses.\n\nE. Pursuant to its rules, the Council may issue a duplicate\n\nlicense to a person licensed pursuant to the provisions of the\n\nOklahoma Security Guard and Private Investigator Act. The Council\n\nmay assess a fee of Ten Dollars ($10.00) for the issuance of a\n\nduplicate license.
