A Security Guard License, Armed Security Guard License,\n\nPrivate Investigator License, and any conditional license shall be\n\nsubject to denial, suspension, revocation, disciplinary penalty or\n\nfine by the Council on Law Enforcement Education and Training\n\nsubject to the Administrative Procedures Act for, but not limited\n\nto, the following reasons by clear and convincing evidence:\n\n1. Falsification or a willful misrepresentation of information\n\nin:\n\na. an employment application or application to the\n\nCouncil on Law Enforcement Education and Training,\n\nb. records of evidence, or\n\nc. testimony under oath;\n\n2. Failure to successfully complete any prescribed course of\n\ntraining as required by the Council;\n\n3. Violation of a provision of the Oklahoma Security Guard and\n\nPrivate Investigator Act or a rule promulgated pursuant to the act;\n\n4. A conviction, entry of a plea of guilty, nolo contendere, an\n\n\"Alford\" plea or any plea other than a not guilty plea for larceny,\n\ntheft, embezzlement, false pretense, fraud, false personation of a\n\npeace officer, any nonconsensual sex offense, any offense involving\n\na minor as a victim, any offense involving the possession, use,\n\ndistribution or sale of a controlled dangerous substance, any\n\noffense involving a firearm, any felony crime that substantially\n\nrelates to the occupation of a security guard or private\n\ninvestigator and poses a reasonable threat to public safety or any\n\nother offense as prescribed by the Council;\n\n5. Use of beverages containing alcohol while armed with a\n\nfirearm;\n\n6. Knowingly impersonating a law enforcement officer;\n\n7. Failure to obtain or maintain liability insurance coverage\n\nor a surety bond pursuant to subsection J of Section 1750.5 of this\n\ntitle; or\n\n8. Revocation or voluntary surrender of reserve peace officer\n\nor peace officer certification, private security guard license,\n\nprivate investigator license or bail enforcer license in any state\n\nfor a violation of any law or rule or pursuant to a settlement of\n\nany disciplinary action in such state.\n\nB. A Security Agency License or Investigative Agency License\n\nshall be subject to denial, suspension, or revocation, disciplinary\n\npenalty or fine by the Council subject to the Administrative\n\nProcedures Act for, but not limited to, the following reasons by\n\nclear and convincing evidence:\n\n1. Falsification or a willful misrepresentation of information\n\nin:\n\na. an employment application or application to the\n\nCouncil on Law Enforcement Education and Training,\n\nb. records of evidence, or\n\nc. testimony under oath;\n\n2. Violation of any provision of the Oklahoma Security Guard\n\nand Private Investigator Act or a rule adopted pursuant thereto;\n\n3. Employing, authorizing, or permitting an unlicensed,\n\nuninsured or unbonded person to perform a security guard, armed\n\nsecurity guard, unarmed private investigator or armed private\n\ninvestigator function;\n\n4. Permitting a person to perform a security guard, armed\n\nsecurity guard, unarmed private investigator or armed private\n\ninvestigator function, knowing the person has committed any offense\n\nenumerated in subsection A of this section; or\n\n5. Revocation or voluntary surrender of reserve peace officer\n\nor peace officer certification, private security guard license,\n\nprivate investigator license or bail enforcer license in any state\n\nfor a violation of any law or rule or pursuant to a settlement of\n\nany disciplinary action in such state.\n\nC. Upon the effective date of suspension or revocation of any\n\nlicense, the licensee shall have the duty to surrender the license\n\nand any identification card issued pursuant thereto to the Council.\n\nD. As used in this section:\n\n1. \"Substantially relates\" means the nature of criminal conduct\n\nfor which the person was convicted has a direct bearing on the\n59. Upon the effective date of suspension or revocation of any\n\nlicense, the licensee shall have the duty to surrender the license\n\nand any identification card issued pursuant thereto to the Council.\n\nD.
