The Commissioner of Labor on recommendation of the Alarm,\n\nLocksmith and Fire Sprinkler Industry Committee may suspend any\n\nlicense, upon the conviction of any individual named on the license\n\nor on the application for license of a felony, for a period not to\n\nexceed thirty (30) days pending a full investigation by the\n\nCommittee. Such investigation shall be initiated within the thirty-\n\nday period of the suspension. A final determination by the\n\nCommittee shall result in either removal of the suspension or such\n\nsanction as the Commissioner considers appropriate, as provided by\n\nthe Alarm, Locksmith and Fire Sprinkler Industry Act.\n\nB. The Commissioner may revoke or suspend any license,\n\nreprimand any licensee or deny any application for license or\n\nrenewal if, in the judgment of the Committee:\n\n1. The applicant or licensee has violated any provision of the\n\nAlarm, Locksmith and Fire Sprinkler Industry Act or any rule or\n\nregulation promulgated thereto;\n\n2. The applicant or licensee has committed any offense\n\nresulting in the applicant's or licensee's conviction of a felony or\n\ncrime involving moral turpitude. Provided, however, if the\n\napplicant has had no felony convictions at least ten (10) years\n\nprior to making application for a license and the applicant has\n\nshown the Committee that the applicant has been rehabilitated, the\n\nCommittee may recommend the applicant for a license;\n\n3. The applicant or licensee has practiced fraud, deceit,\n\ntheft, larceny, arson, or misrepresentation;\n\n4. The applicant or licensee has made a material misstatement\n\nin any information required by the Committee; or\n\n5. The applicant or licensee has demonstrated incompetence or\n\nuntrustworthiness in the applicant's or licensee's actions.\n\nC. The Committee shall, before final action under subsection B\n\nof this section, provide a thirty-day written notice to the\n\napplicant or licensee involved, of the action intended and give\n\nsufficient opportunity for such person to request an administrative\n\nhearing and to be represented by an attorney. A hearing shall be\n\nscheduled by the Commissioner if so requested as provided in the\n\nAdministrative Procedures Act.\n\nD. In the event the Commissioner denies the application for, or\n\nrevokes or suspends, any license or imposes any reprimand, a record\n\nof such action shall be in writing and officially signed by the\n\nCommissioner. The original copy shall be filed with the Department\n\nof Labor and a copy mailed to the affected applicant or licensee\n\nwithin two (2) days of the final action taken by the Commissioner.\n\nE. Notice of the suspension or revocation of any license shall\n\nbe made public record.\n\nF. A suspended license shall be subject to expiration and may\n\nbe renewed as provided by the Alarm, Locksmith and Fire Sprinkler\n\nIndustry Act, regardless of the term of suspension; provided, a\n\nrenewal shall not remove the suspension term.\n\nG. A revoked license terminates on the date of revocation and\n\ncannot be reinstated; provided, the Commissioner may reverse the\n\nrevocation action. Any licensee whose license is revoked shall\n\napply for a new license and meet all requirements for a license as\n\nstated in the Alarm, Locksmith and Fire Sprinkler Industry Act prior\n\nto engaging in any alarm, locksmith or fire sprinkler industry\n\nbusiness activities.
