Stat. tit. 59, § 59-1820.16","heading":"Suspension, revocation, denial or nonrenewal of","body":"license - Reprimand of licensee.\n\nA. The State Fire Marshal, on recommendation of the Fire\n\nExtinguisher Industry Committee, may suspend any license, upon the\n\nconviction of any individual named on the license or on the\n\napplication for license of a felony, for a period not to exceed\n\nthirty (30) days pending a full investigation by the Committee. The\n\ninvestigation shall be initiated within the thirty-day period of\n\nsuspension. A final determination by the Committee shall result in\n\neither removal of the suspension or such sanction as the State Fire\n\nMarshal considers appropriate, as provided by the Fire Extinguisher\n\nLicensing Act.\n\nB. The State Fire Marshal may revoke or suspend any license,\n\nreprimand any licensee or deny any application for license or\n\nrenewal if, in the judgment of the Committee:\n\n1. The applicant or licensee has violated any provision of the\n\nFire Extinguisher Licensing Act or any rule promulgated under the\n\nFire Extinguisher Licensing Act;\n\n2. The applicant or licensee has practiced fraud, deceit, or\n\nmisrepresentation;\n\n3. The applicant or licensee has made a material misstatement\n\nin any information required by the State Fire Marshal Commission; or\n\n4. The applicant or licensee has demonstrated incompetence or\n\nuntrustworthiness in his or her actions.\n\nC. The Committee shall, before final action under subsection B\n\nof this section, provide thirty (30) days of written notice to the\n\napplicant or licensee involved in the action intended and give\n\nsufficient opportunity for the person to request a hearing before\n\nthe Committee and the State Fire Marshal and to be represented by an\n\nattorney. A hearing shall be scheduled by the Committee upon\n\nrequest by the applicant or licensee.\n\nD. In the event the State Fire Marshal denies the application\n\nfor, or revokes or suspends, any license or imposes any reprimand, a\n\nrecord of such action shall be in writing and officially signed by\n\nthe State Fire Marshal. The original copy shall be filed with the\n\nState Fire Marshal Commission and a copy mailed to the affected\n\napplicant or licensee within two (2) days of the final action taken\n\nby the State Fire Marshal.\n\nE. Notice of the suspension or revocation of any license by the\n\nState Fire Marshal shall be sent by the Committee to law enforcement\n\nagencies and fire departments in the principal areas of operation of\n\nthe licensee.\n\nF. A suspended license shall be subject to expiration and may\n\nbe renewed as provided by the Fire Extinguisher Licensing Act,\n\nregardless of suspension; provided, the renewal shall not remove the\n\nsuspension.\n\nG. A revoked license terminates on the date of revocation and\n\ncannot be reinstated; provided, the State Fire Marshal may reverse\n\nthe revocation action. Any licensee whose license is revoked shall\n\napply for a new license and meet all requirements for a license as\n\nstated in the Fire Extinguisher Licensing Act prior to engaging in\n\nany fire extinguisher industry business activities.
