Stat. tit. 59, § 59-1871","heading":"Definitions","body":"For purposes of the Licensed Alcohol and Drug Counselors Act:\n\n1. \"Alcohol and drug counseling\" means the application of\n\ncounseling principles for:\n\na. substance use disorders, or\n\nb. substance abuse disorders and co-occurring disorders\n\nin order to:\n\n(1) develop an understanding of substance abuse and\n\nco-occurring disorders,\n\n(2) permit licensed alcohol and drug counselors to\n\nprevent, diagnose or treat substance abuse and to\n\nprevent, diagnose or treat co-occurring\n\ndisorders,\n\n(3) permit licensed alcohol and drug counselors to\n\nconduct assessments or diagnoses for the purpose\n\nof establishing treatment goals and objectives\n\nfor substance abuse and to establish treatment\n\ngoals and objectives for co-occurring disorders,\n\nand\n\n(4) plan, implement or evaluate treatment plans using\n\ncounseling treatment interventions;\n\n2. \"Alcohol and drug counseling\", as a certified alcohol and\n\ndrug counselor, means the application of counseling principles for:\n\na. substance use disorders, or\n\nb. substance abuse disorders in order to:\n\n(1) develop an understanding of alcoholism and drug\n\ndependency problems,\n\n(2) prevent, diagnose or treat alcohol and drug\n\ndependency problems,\n\n(3) conduct assessments or diagnosis for the purpose\n\nof establishing treatment goals and objectives\n\nfor substance abuse,\n\n(4) plan, implement or evaluate treatment plans using\n\ncounseling treatment interventions for substance\n\nabuse, and\n\n(5) permit certified alcohol and drug counselors\n\ncertified in co-occurring disorders to recognize\n\nco-occurring disorders and integrate that\n\nrecognition into substance abuse treatment,\n\nprovided the certified alcohol and drug counselor\n\nis working in a nationally accredited or Oklahoma\n\nDepartment of Mental Health and Substance Abuse\n\nServices certified agency and is working under\n\nthe supervision of a supervisor approved by the\n\nOklahoma Board of Licensed Alcohol And Drug\n\nCounselors pursuant to paragraph 13 of this\n\nsection and who is a licensed alcohol and drug\n\ncounselor that is licensed in mental health and\n\nsubstance abuse, a licensed alcohol and drug\n\ncounselor that holds a co-occurring certification\n\nfrom the Board or a licensed mental health\n\nprofessional. Certified alcohol and drug\n\ncounselors shall meet or exceed the Certified Co-\n\nOccurring Disorders Professional Standards as\n\nlaid out in the standards promulgated by the\n\nInternational Certification \u0026 Reciprocity\n\nConsortium, any successor organization to the\n\nInternational Certification and Reciprocity\n\nConsortium or another national or international\n\norganization that has similar standards equal to\n\nor higher than the International Certification\n\nand Reciprocity Consortium.\n\nCertified alcohol and drug counselors may not provide private or\n\nindependent practice for co-occurring disorders;\n\n3. \"Board\" means the Oklahoma Board of Licensed Alcohol and\n\nDrug Counselors, created by Section 1873 of this title;\n\n4. \"Certified alcohol and drug counselor\" means any person who\n\nis not exempt pursuant to the provisions of Section 1872 of this\n\ntitle and is not licensed under the Licensed Alcohol and Drug\n\nCounselors Act, but who provides alcohol and drug counseling\n\nservices within the scope of practice while employed by an entity\n\ncertified by the Department of Mental Health and Substance Abuse\n\nServices, or who is exempt from such certification, or who is under\n\nthe supervision of a person recognized by the Oklahoma Board of\n\nLicensed Alcohol and Drug Counselors as a supervisor. A certified\n\nalcohol and drug counselor may provide counseling services for co-\n\noccurring disorders if he or she has been certified by the Board to\n\nprovide counseling as provided in this section for co-occurring\n\ndisorders;\n\n5. \"Certified alcohol and drug counselor candidate\" or\n\n\"licensed alcohol and drug counselor candidate\" means a person who\nol and drug counselor may provide counseling services for co-\n\noccurring disorders if he or she has been certified by the Board to\n\nprovide counseling as provided in this section for co-occurring\n\ndisorders;\n\n5. \"Certified alcohol and drug counselor candidate\" or\n\n\"licensed alcohol and drug counselor candidate\" means a person who\n\nhas made application for certification or licensure and who has been\n\nauthorized by the board to practice alcohol and drug counseling\n\nunder supervision while completing the required work experience;\n\n6. \"Consulting\" means interpreting or reporting scientific fact\n\nor theory in counseling to provide assistance in solving current or\n\npotential problems of individuals, groups or organizations;\n\n7. \"Co-occurring disorder\" means a disorder in which\n\nindividuals have at least one mental health disorder as defined in\n\nthe most current version of the Diagnostic and Statistical Manual\n\nand a substance abuse disorder as defined in paragraph 14 of this\n\nsection. While these disorders may interact differently in any one\n\nperson at least one disorder of each type can be diagnosed\n\nindependently of the other;\n\n8. \"International Certification \u0026 Reciprocity Consortium\n\nStandards\" means the standards enumerated by the International\n\nCertification and Reciprocity Consortium, any successor organization\n\nto the Consortium or another national or international organization\n\nthat has similar standards equal to or higher than the International\n\nCertification and Reciprocity Consortium, that includes requirements\n\nregarding education, exams, degrees, coursework, supervision,\n\ncontinuing education, and ethics for individuals seeking a certified\n\nco-occurring disorders professional certification from the\n\nConsortium. The requirement to meet these standards shall never\n\nfall below the requirements set forth by the Consortium on June 1,\n\n2008.\n\n9. \"Licensed alcohol and drug counselor\" means any person who\n\nprovides alcohol and drug counseling services within the scope of\n\npractice, including co-occurring disorders, for compensation to any\n\nperson and is licensed pursuant to the provisions of the Licensed\n\nAlcohol and Drug Counselors Act. The term \"licensed alcohol and\n\ndrug counselor\" shall not include those professions exempted by\n\nSection 1872 of this title;\n\n10. \"Licensed alcohol and drug counselor/mental health\" or\n\n\"LADC/MH\" means a licensed alcohol and drug counselor who has been\n\ndetermined by the Board to meet the requirements to include the\n\nassessment, diagnosis, and treatment of mental health disorders\n\nwithin the counselor's scope of practice, regardless of whether the\n\nmental health disorders are co-occurring;\n\n11. \"Recovery\" means a voluntary lifestyle, maintained as the\n\nresult of one's diagnosis, treatment or self-disclosure of a\n\nsubstance abuse disorder, characterized by complete abstinence from\n\nalcohol, and all other mind altering drugs or chemicals except\n\ntobacco and drugs used as prescribed by an authorized licensed\n\nmedical professional and the absence of pathological compulsive\n\nbehavior;\n\n12. \"Relapse\" means the resumption of use of alcohol or other\n\nmind-altering drugs or chemicals, except tobacco and drugs used as\n\nprescribed by an authorized licensed medical professional, or\n\nresumption of pathological compulsive behavior, despite having\n\npreviously been diagnosed, treated or self-disclosed as having a\n\nsubstance abuse disorder and been in recovery;\n\n13. \"Supervisor\" means:\n\na. a licensed alcohol and drug counselor who meets the\n\nrequirements established by the board to supervise\n\ncertified alcohol and drug counselors, certified\n\nalcohol and drug counselor candidates or licensed\n\nalcohol and drug counselor candidates and has been\n\napproved by the Oklahoma Board of Licensed Alcohol and\n\nDrug Counselors as a supervisor, or\nand been in recovery;\n\n13. \"Supervisor\" means:\n\na. a licensed alcohol and drug counselor who meets the\n\nrequirements established by the board to supervise\n\ncertified alcohol and drug counselors, certified\n\nalcohol and drug counselor candidates or licensed\n\nalcohol and drug counselor candidates and has been\n\napproved by the Oklahoma Board of Licensed Alcohol and\n\nDrug Counselors as a supervisor, or\n\nb. a licensed mental health professional approved by the\n\nBoard to supervise certified alcohol and drug\n\ncounselors who have received co-occurring\n\ncertification, certified alcohol and drug counselors\n\nwho are candidates for co-occurring certification or\n\nlicensed alcohol drug and counselors who are\n\ncandidates for co-occurring certification;\n\n14. \"Substance abuse disorder\" means the repeated pathological\n\nuse of substances including alcohol and other mind-altering drugs or\n\nchemicals, except tobacco, or repeated pathological compulsive\n\nbehaviors which cause physical, psychological, emotional, economic,\n\nlegal, social or other harm to the individual afflicted or to others\n\naffected by the individual's affliction. As used in the Licensed\n\nAlcohol and Drug Counselors Act, substance abuse disorder shall\n\ninclude not only those instances where withdrawal from or tolerance\n\nto the substance is present but also those instances involving use\n\nand abuse of substances;\n\n15. \"Supervised practicum experience\" means volunteer or paid\n\nwork experience in the core functions of substance abuse counseling\n\nas delineated by the Oklahoma Board of Licensed Alcohol and Drug\n\nCounselors;\n\n16. \"Supervised work experience\" means voluntary or paid work\n\nexperience in providing alcohol and drug counseling services to\n\nindividuals under the supervision of a licensed alcohol and drug\n\ncounselor; and\n\n17. \"Scope of practice\" means acting within the boundaries of\n\ncompetence based on education, training, supervised experience,\n\nstate and national professional credentials, and appropriate\n\nprofessional experience.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2ea5fc1f02e0bb51eb42003e332429d02666f5ceaca8c2d7a35f95ed2b3cf5cf","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1870","next":"us-ok/okla.-stat.-tit.-59-59-1872"},"notice":"GroundRules: Original legal text.
