There is hereby re-created, to continue until July 1, 2028,\n\nin accordance with the provisions of the Oklahoma Sunset Law, the\n\nOklahoma Board of Licensed Alcohol and Drug Counselors, consisting\n\nof seven (7) members, to be appointed by the Governor, with the\n\nadvice and consent of the Senate, as follows:\n\n1. a. Six members who shall be alcohol and drug counselors\n\ncertified by an entity recognized to do professional\n\nalcohol and drug counseling certification in this\n\nstate; provided, however, five of such members shall\n\nsubsequently secure licensure and one such member\n\nshall subsequently secure certification, pursuant to\n\nthe provisions of the Licensed Alcohol and Drug\n\nCounselors Act, no later than January 1, 2005.\n\nb. Thereafter, five members shall be licensed alcohol and\n\ndrug counselors at the time of appointment, and one\n\nmember shall be certified as an alcohol and drug\n\ncounselor at the time of appointment.\n\nc. Pursuant to the provisions of this paragraph, the\n\nGovernor shall appoint:\n\n(1) four members from a list of names submitted by\n\nthe Oklahoma Drug and Alcohol Professional\n\nCounselor Association,\n\n(2) one member from a list of names submitted by the\n\nOklahoma Substance Abuse Services Alliance, and\n\n(3) one member from a list of names submitted by the\n\nOklahoma Citizen Advocates for Recovery and\n\nTransformation Association.\n\nd. One member shall be appointed from and shall represent\n\nthe general public. Such member shall be a resident\n\nof this state who has attained the age of majority and\n\nshall not be, nor shall ever have been, a licensed or\n\ncertified alcohol and drug counselor, or the spouse of\n\na licensed or certified alcohol and drug counselor, or\n\na person who has ever had any material financial\n\ninterest in the provision of alcohol and drug\n\ncounseling services or has engaged in any activity\n\ndirectly related to the practice of alcohol and drug\n\ncounseling.\n\n2. The composition of the Board shall include five members who\n\nhold a master’s or higher degree and one member whose highest degree\n\nheld is a bachelor’s degree.\n\n3. The Governor shall appoint the members to the Board no later\n\nthan July 1, 2004.\n\nB. Each member of the Board appointed as a licensed alcohol and\n\ndrug counselor shall:\n\n1. Be certified or licensed to engage in the practice of\n\nalcohol and drug counseling in this state and shall be in good\n\nstanding; and\n\n2. Have at least three (3) years of experience in the practice\n\nof alcohol and drug counseling in this state.\n\nC. Two of the members initially appointed shall serve three-\n\nyear terms; two shall serve four-year terms; and three shall serve\n\nfive-year terms, as designated by the Governor. Thereafter, the\n\nterms of all members shall be five (5) years.\n\nD. A vacancy on the Board shall be filled in the same manner as\n\nthe original appointment for the balance of the unexpired term.\n\nMembers may succeed themselves but shall serve no more than two\n\nconsecutive terms. Each member shall serve until a successor is\n\nappointed and qualified.\n\nE. Members of the Board may be removed from office for one or\n\nmore of the following reasons:\n\n1. The refusal or inability for any reason to perform the\n\nduties of a Board member in an efficient, responsible and\n\nprofessional manner;\n\n2. The misuse of office for pecuniary or material gain or for\n\npersonal advantage for self or another;\n\n3. A violation of the laws or rules governing the practice of\n\nalcohol and drug counseling; or\n\n4. Conviction of a felony as verified by a certified copy of\n\nthe record of the court of conviction.\n\nF.
