Stat. tit. 59, § 59-1905","heading":"Duties and responsibilities of State Board of Behavioral","body":"Health Licensure.\n\nA. The State Board of Behavioral Health Licensure shall:\n\n1. Prescribe, adopt and promulgate rules to implement\n\nand enforce the provisions of the Licensed Professional\n\nCounselors Act, including the adoption of the State\n\nDepartment of Health rules by reference;\n\n2. Adopt and establish rules of professional conduct;\n\n3. Set license and examination fees as required by the Licensed\n\nProfessional Counselors Act; and\n\n4. Promulgate rules for licensed professional counselors who\n\nare licensed outside of Oklahoma to provide counseling services\n\napproved by the Licensed Professional Counselors Act, the Marital\n\nand Family Therapist Licensure Act, and the Licensed Behavioral\n\nPractitioner Act. Provided, such rules shall only be valid for the\n\nduration of a declaration of emergency issued by the Governor or the\n\nLegislature pursuant to the Oklahoma Emergency Management Act of\n\n2003 or a declaration of a catastrophic health emergency issued by\n\nthe Governor pursuant to the Catastrophic Health Emergency Powers\n\nAct. Provided, such rules shall only authorize the provision of\n\nservices that are pro bono or reimbursed by nongovernmental\n\nentities. Nothing in this section shall be construed as to permit\n\nthe adoption of permanent rules weakening the licensing requirements\n\nestablished by the Licensed Professional Counselors Act, the Marital\n\nand Family Therapist Licensure Act, and the Licensed Behavioral\n\nPractitioner Act.\n\nB. The Board shall have the authority to:\n\n1. Seek injunctive relief;\n\n2. Request the district attorney to bring an action to enforce\n\nthe provisions of the Licensed Professional Counselors Act;\n\n3. Receive fees and deposit said fees into the Licensed\n\nProfessional Counselors Revolving Fund as required by the Licensed\n\nProfessional Counselors Act;\n\n4. Issue, renew, revoke, deny, suspend and place on probation\n\nlicenses to practice professional counseling pursuant to the\n\nprovisions of the Licensed Professional Counselors Act;\n\n5. Examine all qualified applicants for licenses to practice\n\nprofessional counseling;\n\n6. Request assistance from the State Board of Medical Licensure\n\nand Supervision for the purposes of investigating complaints and\n\npossible violations of the Licensed Professional Counselors Act;\n\n7. Accept grants and gifts from various foundations and\n\ninstitutions; and\n\n8.
