No person licensed pursuant to the provisions of the\n\nLicensed Behavioral Practitioner Act shall disclose any information\n\nthe licensee may have acquired from persons consulting the licensee\n\nin the licensee’s professional capacity as a behavioral practitioner\n\nor be compelled to disclose such information except:\n\n1. With the written consent of the client, or in the case of\n\ndeath or disability of the client, the consent of the client’s\n\npersonal representative or other person authorized to sue or the\n\nbeneficiary of any insurance policy on the client’s life, health, or\n\nphysical condition;\n\n2. If the client is a child under the age of eighteen (18)\n\nyears and the information acquired by the licensed person indicated\n\nthat the child was the victim or subject of a crime, the licensed\n\nperson may be required to testify fully in relation thereto upon an\n\nexamination, trial, or other proceeding in which the commission of\n\nsuch a crime is a subject of the inquiry;\n\n3. If the client waives the privilege by bringing charges\n\nagainst the licensed person;\n\n4. When failure to disclose such information presents a danger\n\nto the health of any person; or\n\n5. If the licensed behavioral practitioner is a party to a\n\ncivil, criminal, or disciplinary action arising from such therapy,\n\nin which case any waiver of the privilege accorded by this section\n\nshall be limited to that action.\n\nB. No information shall be treated as privileged and there\n\nshall be no privileges created by the Licensed Behavioral\n\nPractitioner Act as to any information acquired by the person\n\nlicensed pursuant to the Licensed Behavioral Practitioner Act when\n\nsuch information pertains to criminal acts or violation of any law.\n\nC. The Licensed Behavioral Practitioner Act shall not be\n\nconstrued to prohibit any licensed person from testifying in court\n\nhearings concerning matters of adoption, child abuse, child neglect,\n\nbattery, or matters pertaining to the welfare of children or from\n\nseeking collaboration or consultation with professional colleagues\n\nor administrative superiors on behalf of this client.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b3c70a45ecd7686a8759b61aee5c3c829f6fbbb67ef1dfef00b94d500c8d9aad","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1938","next":"us-ok/okla.-stat.-tit.-59-59-1940"},"notice":"GroundRules: Original legal text.
