Stat. tit. 59, § 59-199.1","heading":"Definitions","body":"As used in the Oklahoma Cosmetology and Barbering Act:\n\n1. “Apprentice” means a person who is engaged in learning the\n\npractice of cosmetology or barbering in a cosmetology or barbering\n\nestablishment;\n\n2. “Barber” or “barber stylist” means any person who engages in\n\nthe practice of barbering;\n\n3. “Barbering” means the following practices, when done upon\n\nthe upper part of the human body for cosmetic purposes and when done\n\nfor payment either directly or indirectly for the general public,\n\nconstitute the practice of barbering, to wit: Shaving or trimming\n\nthe beard or cutting the hair; giving facial or scalp massages or\n\ntreatment with oils, creams, lotions or other preparations, either\n\nby hand or mechanical appliances; singeing, shampooing or applying\n\nlighteners or color to the hair or applying hair tonics; applying\n\ncosmetic preparations, antiseptics, powders, oils, clays or lotions\n\nto scalp, face, neck or upper part of the body; and removing\n\nsuperfluous hair from the face, neck or upper part of the body;\n\n4. “Barber establishment” means an establishment or place of\n\nbusiness where one or more persons are engaged in the practice of\n\nbarbering, but shall not include barber schools or colleges;\n\n5. “Barber school” or “barber college” means an establishment\n\noperated for the purpose of teaching barbering;\n\n6. “Blow-dry styling” means the practice of shampooing,\n\nconditioning, drying, arranging, curling, straightening, or styling\n\nhair using mechanical devices, hairsprays, and topical agents\n\nincluding, but not limited to, balms, oils, and serums. Blow-dry\n\nstyling shall include the use and styling of hair extensions, hair\n\npieces, and wigs. Blow-dry styling shall not include cutting hair\n\nor the application of dyes, bleach, reactive chemicals, keratin\n\ntreatments, or other preparations for the coloring and altering of\n\nhair structure. An individual certified to practice blow-dry\n\nstyling shall fulfill instruction requirements related to general\n\nsafety and sanitation for no less than twelve (12) hours, four (4)\n\nhours being an instruction in using mechanical devices for drying,\n\ncurling, straightening, or styling hair, from the State Board of\n\nCosmetology and Barbering before making any such applications. No\n\nestablishment licensing and inspection requirements pursuant to this\n\nact shall be required of an establishment where a person performs\n\nblow-dry styling services;\n\n7. “Board” means the State Board of Cosmetology and Barbering;\n\n8. “Cosmetic studio” means any place or premises where\n\ndemonstrators give demonstrations, without compensation, for the\n\npurpose only of advertising and selling cosmetics. Cosmetic studios\n\nproviding any place or premises where demonstrators give\n\ndemonstrations as defined in this paragraph shall not be required to\n\nhold a license or certification under the Oklahoma Cosmetology and\n\nBarbering Act;\n\n9. “Cosmetology” means the practices generally and usually\n\nperformed by and known as the occupation of beauticians, beauty\n\nculturists, beauty operators, cosmetologists, or hairdressers or of\n\nany other person holding himself or herself out as practicing\n\ncosmetology by whatever designation and within the meaning of the\n\nOklahoma Cosmetology and Barbering Act and in or upon whatever place\n\nor premises. Cosmetology shall include, but not be limited to, any\n\none or combination of the following practices: bleaching,\n\ncleansing, curling, cutting, coloring, dressing, removing, singeing,\n\nstyling, waving, or similar work upon the hair of any person by any\n\nmeans, whether with hands or mechanical or electrical apparatus or\n\nappliances. Nothing in the Oklahoma Cosmetology and Barbering Act\n\nshall be construed to prohibit the use of hands or mechanical or\n\nelectrical apparatus or appliances for the nonpermanent removal of\n\nhair from the human body without puncturing of the skin or the use\ning, waving, or similar work upon the hair of any person by any\n\nmeans, whether with hands or mechanical or electrical apparatus or\n\nappliances. Nothing in the Oklahoma Cosmetology and Barbering Act\n\nshall be construed to prohibit the use of hands or mechanical or\n\nelectrical apparatus or appliances for the nonpermanent removal of\n\nhair from the human body without puncturing of the skin or the use\n\nof cosmetic preparations, antiseptics, tonics, lotions, or creams,\n\nor massaging, cleansing, stimulating, exercising, beautifying, or\n\nsimilarly working the scalp, face, neck, arms, or the manicuring of\n\nthe nails of any person, exclusive of such of the foregoing\n\npractices as are within the scope of practice of the healing arts as\n\nprovided by law;\n\n10. “Cosmetology establishment” means an establishment or place\n\nof business where one or more persons are engaged in the practices\n\nof cosmetology but shall not include cosmetology schools or\n\ncolleges;\n\n11. “Cosmetology or barber school/college” means any place or\n\npremises where instruction in any or all the practices of\n\ncosmetology or barbering is given. Any person, firm, institution or\n\ncorporation, who holds himself, herself or itself out as a school to\n\nteach and train, or any person, firm, institution or corporation who\n\nshall teach and train any other person or persons in any of the\n\npractices of cosmetology or barbering is hereby declared to be\n\nengaged in operating a cosmetology and/or barber school, and shall\n\nbe subject to the provisions of the Oklahoma Cosmetology and\n\nBarbering Act. Licensed cosmetology and/or barber schools may offer\n\neducation to secondary and postsecondary students in this state;\n\n12. “Demonstrator” means a person who is not licensed in this\n\nstate as an operator or instructor and who demonstrates any cosmetic\n\npreparation. An individual solely acting as a demonstrator as\n\ndefined in this paragraph shall not be required to hold a license or\n\ncertification under the Oklahoma Cosmetology and Barbering Act;\n\n13. “Eyelash extension application” means the application,\n\nremoval, and trimming of threadlike natural or synthetic fibers to\n\nan eyelash. Eyelash extension application shall include the\n\ncleaning of lashes. Eyelash extension application shall not include\n\ncolor agents, straightening agents, permanent wave solutions,\n\nbleaching agents, or any other service that may be considered under\n\nthe practice of cosmetology;\n\n14. “Eyelash extension instructor” means a person certified by\n\nthe Board or a manufacturer of eyelash extension application\n\nproducts. The person shall pass a state written exam relating to\n\ngeneral safety and sanitation from the Board;\n\n15. “Eyelash extension specialist” means a person certified by\n\nthe Board to perform eyelash extension application. The person\n\nshall pass a state written exam relating to general safety and\n\nsanitation from the Board;\n\n16. “Facial/Esthetics instructor” means a person licensed by\n\nthe Board as a qualified teacher of the art and science of facial\n\nand esthetics theory and practice;\n\n17. “Facialist/Esthetician” means any person who gives facials\n\nfor compensation. For a facialist/esthetician fulfilling the\n\nrequirements of another state, territory, or province and holding a\n\ncurrent license as verified by certification, the Board may issue a\n\nlicense pursuant to Section 199.13 of this title;\n\n18. “Hairbraiding technician” means a person who performs\n\nhairbraiding, hairweaving techniques, and hair extensions in a\n\nlicensed cosmetology establishment. An individual solely acting as\n\na hairbraiding technician as defined in this paragraph shall not be\n\nrequired to hold a license or certification under the Oklahoma\n\nCosmetology and Barbering Act;\n\n19. “Hairbraiding” means the service of twisting, wrapping,\n\nweaving, extending, locking, or braiding hair by hand or with\n\nmechanical devices. Hairbraiding shall include the use of natural\nstablishment. An individual solely acting as\n\na hairbraiding technician as defined in this paragraph shall not be\n\nrequired to hold a license or certification under the Oklahoma\n\nCosmetology and Barbering Act;\n\n19. “Hairbraiding” means the service of twisting, wrapping,\n\nweaving, extending, locking, or braiding hair by hand or with\n\nmechanical devices. Hairbraiding shall include the use of natural\n\nor synthetic hair extensions, natural or synthetic hair and fibers,\n\ndecorative beads or other hair accessories, or twisting, wrapping,\n\nweaving, extending, locking, or braiding hair, or the making of wigs\n\nfrom natural hair, natural fibers, synthetic fibers, or hair\n\nextensions. Hairbraiding shall include the use of topical agents\n\nsuch as conditioners, gels, moisturizers, oils, pomades, and\n\nshampoos. Hairbraiding shall not include the application of dyes,\n\nreactive chemicals, or other preparations to alter the color of the\n\nhair or to straighten, curl, or alter the structure of the hair or\n\nthe use of chemical hair jointing agents such as synthetic tape,\n\nkeratin bonds, or fusion bonds. Hairbraiding shall not be\n\nconsidered the practice of cosmetology. Individuals solely\n\npracticing hairbraiding as defined in this paragraph shall not be\n\nrequired to hold a license or certification under the Oklahoma\n\nCosmetology and Barbering Act;\n\n20. “Hybrid learning” means courses that combine face-to-face\n\nclassroom instruction with online, computer-based learning;\n\n21. “Makeup application” means the application of a cosmetic to\n\nenhance the appearance of the face or skin including, but not\n\nlimited to, powder, foundation, rouge, eyeshadow, eyeliner, mascara,\n\nor lipstick. Makeup application shall include the application of\n\nmakeup applied using an airbrush. Makeup application shall not\n\ninclude the application of permanent makeup or tattooing;\n\n22. “Makeup artist” means a person certified to practice makeup\n\napplication. No establishment licensing and inspection requirements\n\npursuant to this act shall be required of an establishment where a\n\nperson performs makeup application services; provided, that an\n\nindividual certified to practice makeup application fulfills\n\ninstruction requirements related to general safety and sanitation\n\nfor no less than eight (8) hours from the Board before making any\n\nsuch applications;\n\n23. “Manicurist/Nail technician” means a person who gives\n\nmanicures, gives pedicures, or applies artificial nails;\n\n24. “Manicurist/Nail technician instructor” means a person\n\nlicensed by the Board as a qualified teacher of the art and science\n\nof nail technology theory and practice;\n\n25. “Master barber” means any person who has engaged in the\n\npractice of barbering for a cumulative period no less than fifteen\nt/Nail technician” means a person who gives\n\nmanicures, gives pedicures, or applies artificial nails;\n\n24. “Manicurist/Nail technician instructor” means a person\n\nlicensed by the Board as a qualified teacher of the art and science\n\nof nail technology theory and practice;\n\n25. “Master barber” means any person who has engaged in the\n\npractice of barbering for a cumulative period no less than fifteen\n\n(15) years. A master barber may provide instruction to no more than\n\ntwo registered apprentices at any one time. At such time as a\n\nbarber fulfills the requirements of a master barber, he or she may\n\nrequest of the Board for licensure as a master barber;\n\n26. “Master barber instructor” means a person who gives\n\ninstruction in barbering or any practices thereof;\n\n27. “Master cosmetologist” means any person who has engaged in\n\nthe practice of cosmetology for a cumulative period no less than\n\nfifteen (15) years. A master cosmetologist may provide instruction\n\nto no more than two registered apprentices at any one time. At such\n\ntime as a cosmetologist fulfills the requirements of a master\n\ncosmetologist, he or she may request of the Board for licensure as a\n\nmaster cosmetologist;\n\n28. “Master cosmetology instructor” means a person who gives\n\ninstruction in cosmetology or any practices thereof;\n\n29. “Postsecondary institution” means a school licensed to\n\nteach students according to prescribed curriculum as in paragraph 1\n\nof subsection G of Section 199.7 of this title and in Board rule\n\n175:10-3-34(a);\n\n30. “Public school” means any state-supported institution\n\nconducting a cosmetology program;\n\n31. “Secondary institution” means a school licensed to teach\n\nstudents eligible for credit of five hundred (500) hours of related\n\nsubjects as prescribed in paragraph 2 of subsection G of Section\n\n199.7 of this title and in Board rule 175:10-3-34(b);\n\n32. “Shampooing” means the practice of washing or cleaning hair\n\nby use of shampooing, conditioning, and drying, which may use\n\ntopical agents including, but not limited to, balms, oils, and\n\nserums. Shampooing shall include the washing or cleaning of hair\n\nextensions, hair pieces, and wigs. Shampooing shall not include\n\ncutting hair or the application of dyes, bleach, reactive chemicals,\n\nkeratin treatments, or other preparations for the coloring and\n\naltering of hair structure.
