The State Board of Cosmetology and Barbering shall issue a\n\nlicense to any nonprofit 501(c)(3) tax-exempt school located within\n\na correctional facility in this state that proposes to provide\n\ncosmetology or barbering training courses designed to qualify\n\npersons for licensure to practice cosmetology or barbering.\n\nB. 1. Any nonprofit 501(c)(3) tax-exempt school seeking to\n\noperate within a correctional facility shall submit an application\n\nto the Board with the following:\n\na. whether the school intends to operate as a secondary\n\nor postsecondary establishment,\n\nb. the names, addresses, and contact information of the:\n\n(1) Director of Corrections,\n\n(2) Chief Administrator of Classification and\n\nPrograms of the Department of Corrections,\n\n(3) Department of Corrections’ administrator of\n\nprograms,\n\n(4) warden of the correctional facility where the\n\nschool is to be located, and\n\n(5) instructors for the proposed program,\n\nc. a notarized affidavit stating the source of sufficient\n\nbond coverage and that the building where the school\n\nis proposed to be conducted is owned by the Department\n\nof Corrections,\n\nd. the contact information of the correctional facility,\n\nand\n\ne. a brief description of the proposed education areas\n\nwithin the correctional facility location, other\n\ntraining sections located within the correctional\n\nfacility, and parking areas.\n\n2. An applicant shall obtain a memorandum of understanding from\n\nthe Department stating that the Department shall allow the applicant\n\nuse of the designated area for one (1) year, or a sum of twelve-\n\nmonth increments, that shall be used for the proposed school to\n\noperate.\n\n3. Nonprofit 501(c)(3) tax-exempt schools within a correctional\n\nfacility shall not charge tuition. Education shall be provided free\n\nof cost to all students enrolled in the programs. All supplies\n\nshall either be purchased from funds obtained through grants or by\n\nprivate donations made to the organization. The Board shall not\n\nrequire a financial statement to be furnished by the school.\n\n4. All licenses, work permits, registration receipts, student\n\npermits, and all other information required by the Board shall be\n\nposted conspicuously.\n\n5. Licensed instructors shall adhere to all Department\n\nrequirements necessary for visitation within the correctional\n\nfacility.\n\nC. The Board shall permit an applicant’s inmate identification\n\nbadge as his or her identification for purposes of enrollment. A\n\nstudent enrolled to take classes from a nonprofit 501(c)(3) tax-\n\nexempt school within a correctional facility shall automatically be\n\nconsidered a low-income individual.
