Stat. tit. 59, § 59-199.21","heading":"Nonprofit 501(c)(3) school within correctional facility","body":"— Requirements.\n\nA. Any nonprofit 501(c)(3) tax-exempt school located within a\n\ncorrectional facility licensed by the State Board of Cosmetology and\n\nBarbering to provide cosmetology or barbering training courses\n\ndesigned to qualify persons for licensure to practice cosmetology or\n\nbarbering shall adhere to the following:\n\n1. Schools located within a correctional facility shall not\n\nprovide:\n\na. individual student lockers, vending machines, or\n\ncosmetic or wig displays,\n\nb. a private facial and skin care room. All facial and\n\nskin care education shall take place where everyone\n\nmay be seen,\n\nc. a break area. Restrooms shall be gender-specific to\n\nthe institution housing the programs,\n\nd. a drinking fountain or water cooler,\n\ne. hand sanitizer; provided, that dry sanitizer may be\n\npermitted provided it is located in a dispensary area.\n\nIndividual containers are not permitted per Department\n\nof Corrections policy, or\n\nf. individual containers for soiled items. The soiled\n\nitems shall be cleaned and disinfected immediately\n\nafter service is completed; and\n\n2. Schools located within a correctional facility shall:\n\na. hold all supplies required by the school. Supplies\n\nshall be checked out and checked in by students and\n\nmaster instructors, except for metal implements, which\n\nshall be held in a secured area and checked out and\n\nchecked in by a designated clerk,\n\nb. only be required to have one facial chair,\n\nc. provide the facial supply cabinet located inside the\n\ndispensary area,\n\nd. provide a container to store hair pins and clips that\n\nshall be located in the dispensary area. Students\n\nshall check out and check in these items as needed,\n\ne. provide a secure location for all metal implements,\n\nwhich shall include, but not be limited to, shears,\n\nthinning shears, razors, nail clippers, nail and\n\ncuticle trimmers, and metal cuticle pushers. A log\n\nshall be available to document the administration of\n\nall tools and implements by a designated clerk, and\n\nf. store all supplies, other than instructional books, in\n\nthe dispensary area or, as required by this section,\n\nin a secure area.\n\nIf an inspector by the Board provides evidence of the need for\n\nadditional equipment not specified in this section for the\n\nappropriate and safe instruction of the enrolled students, the\n\nschool located within a correctional facility shall provide the\n\nadditional equipment.\n\nB. In the event of a lockdown at a correctional facility where\n\na school is housed, the school shall remain closed until the\n\nlockdown is lifted. School may resume upon confirmation of the\n\nended lockdown. Students may only be exempt from the weekly time\n\nrequirements due to lockdown or outside medical appointments;\n\nprovided, that the Department of Corrections has found reasonable\n\ncause to make such exception.\n\nC.
