The State Board of Cosmetology and Barbering is hereby\n\nauthorized to promulgate rules for governing the examination and\n\nlicensure of cosmetologists, master cosmetologists, manicurists,\n\nnail technicians, estheticians, master cosmetology instructors,\n\nmanicurist instructors, esthetics instructors, barbers, master\n\nbarbers, and master barber instructors. The Board is hereby\n\nauthorized to promulgate rules to govern the sanitary operation of\n\ncosmetology and barbering establishments and to administer fines not\n\nto exceed Fifty Dollars ($50.00) for those licensed and not to\n\nexceed Five Hundred Dollars ($500.00) for those not licensed. Each\n\nday a violation continues shall be construed as a separate offense.\n\nB. The State Board of Cosmetology and Barbering shall have the\n\npower and duty to implement rules of the Board, to issue and renew\n\nlicenses, to inspect cosmetology and barbering establishments and\n\nschools, and to inspect the sanitary operating practices of\n\ncosmetology and barbering licensees, including sanitary conditions\n\nof cosmetology and barbering establishments and schools.\n\nC. It shall be unlawful and constitute a misdemeanor,\n\npunishable upon conviction by a fine not less than Fifty Dollars\n\n($50.00), nor more than One Hundred Fifty Dollars ($150.00), or by\n\nimprisonment in the county jail for not more than thirty (30) days,\n\nor both such fine and imprisonment, for any person, firm, or\n\ncorporation in this state to:\n\n1. Operate or attempt to operate a cosmetology school/college,\n\ncosmetology or barber establishment, cosmetology or barber school or\n\ncollege that offers cosmetology, barbering or both without having\n\nobtained a license therefor from the State Board of Cosmetology and\n\nBarbering;\n\n2. Give or attempt to give instruction in cosmetology or\n\nbarbering, without having obtained an instructor’s license from the\n\nBoard;\n\n3. Practice or offer to practice barbering, cosmetology,\n\nmanicuring, or eyelash extension application without having obtained\n\na license or certification therefor from the Board;\n\n4. Demonstrate as an eyelash extension instructor or operate as\n\nan eyelash extension specialist without having obtained a\n\ncertificate from the Board;\n\n5. Permit any person in one’s employ, supervision, or control\n\nto practice cosmetology or barbering unless that person has obtained\n\nan appropriate license from the Board;\n\n6. Willfully violate any rule promulgated by the Board for the\n\nsanitary management and operation of a cosmetology or barber\n\nestablishment, cosmetology school or barber college; or\n\n7. Violate any of the provisions of the Oklahoma Cosmetology\n\nand Barbering Act.\n\nD. The State Board of Cosmetology and Barbering shall have the\n\nauthority to levy administrative fines not to exceed Five Hundred\n\nDollars ($500.00) for persons practicing cosmetology or barbering\n\nwithout a license, and for owners of establishments who allow\n\nunlicensed individuals to practice cosmetology or barbering without\n\na license in their establishment. Each day a violation continues\n\nshall be a separate offense. The administrative fine shall not\n\nexceed a total of Five Hundred Dollars ($500.00).\n\nE. The provisions of the Oklahoma Cosmetology and Barbering Act\n\nshall not apply to the following persons while such persons are\n\nengaged in the proper discharge of their professional duties:\n\n1. Funeral directors;\n\n2. Persons in the Armed Services;\n\n3. Persons authorized to practice the healing arts or nursing;\n\n4. Regularly employed sales people working in retail\n\nestablishments engaged in the business of selling cosmetics in\n\nsealed packages;\n\n5. Persons employed to render cosmetology or hairstyling\n\nservices in the course of and incidental to the business or\n\nemployers engaged in the theatrical, radio, television, or motion\n\npicture production industries, modeling, or photography;\ning arts or nursing;\n\n4. Regularly employed sales people working in retail\n\nestablishments engaged in the business of selling cosmetics in\n\nsealed packages;\n\n5. Persons employed to render cosmetology or hairstyling\n\nservices in the course of and incidental to the business or\n\nemployers engaged in the theatrical, radio, television, or motion\n\npicture production industries, modeling, or photography;\n\n6. Persons performing shampooing services and no other services\n\nrequiring a license under this act; or\n\n7.
