Each cosmetology and barber school shall be licensed\n\nannually by the State Board of Cosmetology and Barbering.\n\nApplication for the first year’s license for a cosmetology and\n\nbarber school shall be accompanied by a fee of Four Hundred Dollars\n\n($400.00), which shall be retained by the Board if the application\n\nis approved and a license is issued. The annual renewal license fee\n\nfor cosmetology or barber schools shall be One Hundred Twenty-five\n\nDollars ($125.00).\n\nB. 1. No license or renewal thereof for a cosmetology or\n\nbarber school shall be issued unless the owner thereof furnishes to\n\nthe Board a good and sufficient surety bond in the principal sum of\n\nTwo Thousand Dollars ($2,000.00) for the first instructor and an\n\nadditional One Thousand Dollars ($1,000.00) for each additional\n\ninstructor, executed by a surety company authorized to do business\n\nin this state, and conditioned on the faithful performance of the\n\nterms and conditions of all contracts entered into between the owner\n\nof the cosmetology or barber school and all persons enrolling\n\ntherein.\n\n2. The surety bond shall be in a form approved by the Attorney\n\nGeneral and filed in the Office of the Secretary of State. Suit may\n\nbe brought on the bond by any person injured by reason of the breach\n\nof the conditions thereof.\n\nC. It shall be the duty of the owner or manager of a\n\ncosmetology or barber school to enter into a written contract with\n\nall students before permitting students to attend any classes.\n\nContracts shall be made out in triplicate, the original copy to be\n\nretained by the school, the duplicate to be given to the student,\n\nand the triplicate to be filed with the Executive Director of the\n\nBoard.\n\nD. A school licensed or applying for licensure shall maintain\n\nrecognition as an institution of postsecondary study by meeting the\n\nfollowing conditions:\n\n1. The school shall admit as a regular student only an\n\nindividual who has earned a recognized high school diploma, or who\n\nis beyond the age of compulsory high school attendance; and\n\n2. The school shall be licensed by name, or in the case of an\n\napplicant, shall apply for licensure by name, to offer one or more\n\ntraining programs beyond the secondary level.\n\nE. No license for a cosmetology or barber school shall be\n\nissued unless the owner thereof presents evidence satisfactory to\n\nthe Board that the school has satisfactory facilities and equipment\n\nand has instructors qualified to give a course of study as provided\n\nin the Oklahoma Cosmetology and Barbering Act.\n\nF. There shall be included in the curriculum for cosmetology\n\nand barber schools, courses of study in the theory of cosmetology\n\nand barbering related theory, studies in manipulative practices,\n\nsterilization and sanitation, shop management, and such other\n\nrelated subjects as may be approved by the Board.\n\nG. 1. On or before July 1, 2025, the Board shall adopt a\n\ncurriculum of required courses of instruction in theory and training\n\nof either one thousand (1,000) clock hours for nonchemical-use\n\nlicensure or one thousand two hundred fifty (1,250) hours of\n\nchemical-use licensure or an equivalent number of credit hours as\n\nrecognized by the United States Department of Education or a\n\nregional or national accreditation entity recognized by the United\n\nStates Department of Education in a basic course to be taught in all\n\ncosmetology or barbering schools in the state. The basic\n\ncosmetology or barbering course shall be designed to qualify\n\nstudents completing the course to take the examination for a\n\nlicense.\n\n2. On or before July 1, 2025, cosmetology and barber students\n\nin vocational, trade, and industrial cosmetology and barbering\n\nclasses in public schools, parochial schools, private schools or\n\nhome schools shall qualify by completing one thousand (1,000) hours\n\nin a basic course of cosmetology or barbering and two hundred fifty\ntudents completing the course to take the examination for a\n\nlicense.\n\n2. On or before July 1, 2025, cosmetology and barber students\n\nin vocational, trade, and industrial cosmetology and barbering\n\nclasses in public schools, parochial schools, private schools or\n\nhome schools shall qualify by completing one thousand (1,000) hours\n\nin a basic course of cosmetology or barbering and two hundred fifty\n\n(250) hours of approved related subjects to be selected from, but\n\nnot limited to, the following high school courses in a public\n\nschool, parochial, private or home school: psychology, biology,\n\ngeneral science, American history, art, typing I, typing II,\n\nbusiness arithmetic, salesmanship, bookkeeping I, bookkeeping II,\n\nrelated mathematics, English II, English III and English IV.\n\nH. 1. No person shall be eligible to give instruction in\n\ncosmetology or barbering unless the person is the holder of a\n\ncurrent unrevoked instructor license issued by the Board. No person\n\nshall be eligible to give instruction in eyelash extension\n\napplication unless the person is the holder of a current unrevoked\n\neyelash extension instructor certificate issued by the Board. A\n\nmanufacturer of eyelash extension application products shall not be\n\nrequired to obtain an instructor certificate but shall only instruct\n\non eyelash extension products and not the application of eyelash\n\nextensions.\n\n2. Each cosmetology or barber school shall employ at least one\n\ninstructor for the first fifteen students registered therein, and at\n\nleast one additional instructor shall be employed for each\n\nadditional group of fifteen students, or major fraction thereof.\n\n3. Students utilizing hybrid learning programs are included in\n\nthe total student number as referenced in the ratio in paragraph 2\n\nof this subsection.\n\nI. A cosmetology or barbering school may be operated in and as\n\npart of an accredited high school.\n\nJ. No cosmetology or barber school owner or an establishment\n\nowner shall charge students or apprentices for cosmetic materials,\n\nsupplies, apparatus, or machines used by them in practice work. A\n\nreasonable charge may be made by a cosmetology or barber school for\n\nclinical work performed by students upon persons who are not\n\nstudents therein. No instructor shall be permitted to do\n\nprofessional or clinical work in a cosmetology or barber school at\n\nany time.\n\nK. No cosmetology or barber establishment shall ever be\n\noperated in or as a part of a cosmetology school.\n\nL. 1. Students shall:\n\na. have an eighth-grade education or the equivalent\n\nthereof, and\n\nb. be at least sixteen (16) years of age unless they are\n\npublic or private school students who will be sixteen\n\n(16) years of age by November 1 of the year in which\n\ncosmetology or barbering instruction begins.\n\n2. Credit shall not be given to any person by the Board or by a\n\ncosmetology or barber school for hours spent in attending a\n\ncosmetology or barber school unless the person has registered with\n\nthe Board as a student prior to the attendance, except that a\n\nstudent who has attended a cosmetology or barber school out of state\n\nmay receive credit for such attendance for transfer upon proper\n\ncertification as provided by rule of the Board.\n\n3. No student shall be credited with more than eight (8) hours’\n\nattendance in a cosmetology or barber school in any one (1) day.\n\n4. No person shall be eligible to take the Board-issued\n\nexamination for a license unless such person is at least seventeen\nce for transfer upon proper\n\ncertification as provided by rule of the Board.\n\n3. No student shall be credited with more than eight (8) hours’\n\nattendance in a cosmetology or barber school in any one (1) day.\n\n4. No person shall be eligible to take the Board-issued\n\nexamination for a license unless such person is at least seventeen\n\n(17) years of age or a high school graduate.\n\nM. 1. No student shall be eligible to take the examination for\n\na Board-issued license without furnishing to the Board the affidavit\n\nof the owner of the cosmetology or barber school that the student\n\nhas satisfactorily completed the requirements specified in paragraph\n\n1 of subsection G of this section, except public and private school\n\nstudents who will complete the requirements specified in paragraph 2\n\nof subsection G of this section by the close of the current school\n\nyear may take the examination next preceding the end of the school\n\nyear.\n\n2. Students who are eligible to take the examination shall be\n\ngiven an oral examination if requested by their instructor and proof\n\nof qualifying disability is proven.\n\nN. After July 1, 2025, no person shall be eligible to register\n\nfor the examination for an instructor’s license unless such person\n\nis a high school graduate, or has obtained a General Equivalency\n\nDiploma (GED) as to which the applicant shall qualify by tests to be\n\nprescribed by the Board and conducted by qualified examiners\n\nselected by the Board, and has satisfactorily completed all hours\n\nrequired for the appropriate specialty course and an additional six\n\nhundred (600) instructor training hours or equivalent number of\n\ncredit hours as recognized by the United States Department of\n\nEducation or as recognized by a national accreditation entity\n\nprescribed by the Board in a cosmetology or barber school in this\n\nstate\n\nO. The Board shall have the power to conduct examinations\n\naround the state at public locations including, but not limited to,\n\ntechnology center schools.\n\nP. Each cosmetology or barber school shall prominently display\n\nin a conspicuous place above or to the side of the entrance thereto\n\na sign identifying it as an institute of learning.
