Stat. tit. 59, § 59-2001","heading":"Definitions","body":"As used in the Oklahoma Health Spa Act:\n\n1. \"Administrator\" means the Administrator of Consumer Credit\n\nas defined in Section 6-501 of Title 14A of the Oklahoma Statutes;\n\n2. \"Business day\" means any day except a Sunday or a legal\n\nholiday;\n\n3. \"Buyer/Member\" means a natural person who enters into a\n\nhealth spa contract or membership;\n\n4. \"Membership agreement\" means any agreement between a member\n\nand a health spa for use of health spa services;\n\n5. \"Health spa\" means and includes any person, firm,\n\ncorporation, organization, club or association engaged in a program\n\nof physical exercise, which includes the use of one or more of a\n\nsauna, whirlpool, weight-lifting room, massage, steam room, or\n\nexercising machine or device, or exercise rooms, or engaged in the\n\nsale of the right or privilege to use exercise equipment or\n\nfacilities, such as a sauna, whirlpool, weight-lifting room,\n\nmassage, steam room or exercising machine or device or exercise\n\nrooms. The term \"health spa\" shall not include the following:\n\na. bona fide nonprofit organizations, including, but not\n\nlimited to, the Young Men's Christian Association,\n\nYoung Women's Christian Association, or similar\n\norganizations whose functions as health spas are only\n\nincidental to their overall functions and purposes,\n\nb. any private club owned and operated by its members,\n\nc. any organization solely operated for the purpose of\n\nteaching a particular form of self-defense such as\n\njudo or karate,\n\nd. any facility owned or operated by the United States,\n\ne. any facility owned or operated by this state or any of\n\nits political subdivisions,\n\nf. any nonprofit public or private school, college or\n\nuniversity,\n\ng. any facility operated solely for aerobics or toning,\n\nand\n\nh. any facility that only offers month-to-month\n\nmemberships and does not charge any application,\n\nprocess, cancellation, or other service fees;\n\n6. \"Health spa services\" means and includes services,\n\nprivileges, or rights offered for sale or provided by a health spa;\n\n7. \"Initiation fee\" means a nonrecurring fee charged at or near\n\nthe beginning of a health spa membership;\n\n8. \"Monthly fee\" means the total consideration, including but\n\nnot limited to, equipment or locker rental, credit check, finance,\n\nmedical and dietary evaluation, class and training fees, and all\n\nother similar fees or charges and interest, but excluding any\n\ninitiation fee, to be paid by a buyer, divided by the total number\n\nof months of health spa service use allowed by the buyer's contract\n\nor membership, including months or time periods called \"free\" or\n\n\"bonus\" months or time periods and such months or time periods which\n\nare described in any other terms suggesting that they are provided\n\nfree of charge, which months or time periods are given or\n\ncontemplated when the contract or membership is initially executed;\n\n9. \"Prepayment\" means any amount paid in advance of the\n\nmaturity of the health spa membership, to include payment in part or\n\nin full, accelerated monthly fees or any required down payment or\n\ninitiation fee;\n\n10. \"Program\" means any use of a health spa facility for the\n\npurpose of physical exercise in a structured or nonstructured\n\nenvironment; and\n\n11. \"Presale\" means payment of any consideration for services\n\nor the use of facilities made prior to the day on which the services\n\nor facilities of the health spa are fully open and available for\n\nregular use by the members.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"da87a444a34cca89d2880a34abf7d38a55ffd4d22b8a3405911bef3c69c3fbd8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-2000","next":"us-ok/okla.-stat.-tit.-59-59-2002"},"notice":"GroundRules: Original legal text.
