Stat. tit. 59, § 59-2004","heading":"Provisions to be included in contract or membership","body":"agreement.\n\nEvery health spa contract or membership agreement for the sale\n\nof future health spa services which are paid for in advance or which\n\nthe buyer agrees to pay for in future installments shall be in\n\nwriting and shall contain the following provisions:\n\n1. A provision for the penalty-free cancellation of the\n\ncontract or membership agreement within three (3) business days of\n\nits making and refund upon such notice, of all monies paid under the\n\ncontract or membership agreement;\n\n2. A provision for the cancellation of the contract or\n\nmembership agreement if the health spa relocates or goes out of\n\nbusiness and fails to provide alternative facilities within eight\n\n(8) miles of the location designated in the health spa contract or\n\nmembership agreement. Upon receipt of such notice, the health spa\n\nshall refund to the buyer funds paid or accepted in payment of the\n\ncontract or membership agreement in an amount computed by dividing\n\nthe contract price by the number of weeks in the contract or\n\nmembership agreement term and multiplying the result by the number\n\nof weeks remaining in the contract or membership agreement term;\n\n3. A provision for the cancellation of the contract or\n\nmembership agreement if the buyer dies or becomes physically unable\n\nto use a substantial portion of the services for thirty (30) or more\n\nconsecutive days. Upon receipt of such notice, the health spa shall\n\nrefund to the buyer funds paid or accepted in payment of the\n\ncontract or membership agreement in an amount computed by dividing\n\nthe contract price by the number of weeks in the contract or\n\nmembership agreement term and multiplying the result by the number\n\nof weeks remaining in the contract or membership agreement term. In\n\nthe case of disability, the health spa may require the buyer to\n\nsubmit to a physical examination by a doctor agreeable to the buyer\n\nand the health spa. The cost of the examination shall be borne by\n\nthe health spa;\n\n4. A provision that:\n\na. to cancel a contract or membership agreement, the\n\nbuyer shall notify the health spa of cancellation in\n\nwriting, by certified mail, return receipt requested,\n\nor personal delivery, to the address specified in the\n\nhealth spa contract or membership agreement,\n\nb. all moneys to be refunded upon cancellation of the\n\nhealth spa contract or membership agreement shall be\n\npaid within thirty (30) days of receipt of the notice\n\nof cancellation, and\n\nc. if the customer has executed any credit or lien\n\nagreement with the health spa to pay for all or part\n\nof health spa services, any such agreement executed by\n\nthe buyer shall also be returned within sixty (60)\n\ndays after such cancellation;\n\n5. A provision for the penalty-free cancellation of the\n\ncontract or membership agreement if the health spa changes ownership\n\nand relocates and fails to provide notice of the change of ownership\n\nand relocation within thirty (30) days through certified mail to the\n\nbuyer; and\n\n6. A provision for the penalty-free cancellation of the\n\ncontract or membership agreement if the health spa changes ownership\n\nand relocates and fails to obtain written authorization from the\n\nbuyer to continue to collect automatic bank draft deductions.
