Stat. tit. 59, § 59-2005","heading":"Delivery of contract or membership agreement to buyer -","body":"Form and contents of contracts or membership or agreement - Term -\n\nOther laws - Void or voidable contract or membership agreement -\n\nWaiver - Notice of liability.\n\nA. A copy of every health spa contract or membership agreement\n\nshall be delivered to the buyer at the time the contract or\n\nmembership agreement is executed. All health spa contracts or\n\nmembership agreements shall:\n\n1. be in writing, signed by the buyer;\n\n2. designate the date on which the buyer actually signed the\n\ncontract or membership agreement and length of membership;\n\n3. identify services and facilities to be provided;\n\n4. contain the provisions set forth in Section 6 of this act\n\nunder a conspicuous caption: \"BUYER'S RIGHT TO CANCEL\"; and\n\n5. read substantially as follows:\n\nIf you wish to cancel this contract or membership agreement, you\n\nmay cancel by making or delivering written notice to this health\n\nspa. The notice must say that you do not wish to be bound by the\n\ncontract or membership agreement and must be delivered or mailed\n\nbefore midnight of the third business day after you sign this\n\ncontract or membership agreement. The notice must be delivered or\n\nmailed to:\n\n(Health spa shall insert its name and mailing address)\n\nYou may also cancel this contract or membership agreement if\n\nthis spa moves or goes out of business and fails to provide\n\nalternative facilities within eight (8) miles of the location\n\ndesignated in this contract or membership agreement. You may also\n\ncancel if you become disabled; and your estate may cancel in the\n\nevent of your death. You must prove such disability by a doctor's\n\ncertificate, and the health spa may also require that you submit to\n\na physical examination by a doctor agreeable to you and the health\n\nspa. If you cancel, the health spa may retain or collect a portion\n\nof the contract or membership agreement price equal to the\n\nproportionate value of the services or use of facilities you have\n\nalready received.\n\nB. No health spa contract or membership agreement shall have a\n\nduration for a period longer than thirty-six (36) months, however,\n\nthe contract or membership agreement may give the buyer a right of\n\nrenewal.\n\nC. The provisions of the Oklahoma Health Spa Act are not\n\nexclusive and do not relieve the parties or the contracts or\n\nmembership agreements subject thereto from compliance with all other\n\napplicable provisions of law.\n\nD. Any health spa contract or membership agreement which does\n\nnot comply with the applicable provisions of the Oklahoma Health Spa\n\nAct shall be voidable at the option of the buyer.\n\nE. Any health spa contract or membership agreement entered into\n\nby the buyer upon any false or misleading information,\n\nrepresentation, notice or advertisement of the health spa or the\n\nhealth spa's agents shall be void and unenforceable.\n\nF. Any waiver by the buyer of the provisions of the Oklahoma\n\nHealth Spa Act shall be deemed contrary to public policy and shall\n\nbe void and unenforceable.\n\nG. All health spa contracts or membership agreements and any\n\npromissory note executed by the buyer in connection therewith shall\n\ncontain the following provision on the face thereof in at least ten-\n\npoint, boldface type:\n\nNOTICE\n\nANY HOLDER OF THIS CONTRACT OR MEMBERSHIP AGREEMENT IS SUBJECT TO\n\nALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE\n\nSELLER OF GOODS OR SERVICES OBTAINED WITH THE PROCEEDS HEREOF.\n\nRECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY\n\nTHE DEBTOR HEREUNDER.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"889dedd50885ce45a70bccb79b3b8b2d08730ec05730ab20a47f55512c30f748","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-2004","next":"us-ok/okla.-stat.-tit.-59-59-2006"},"notice":"GroundRules: Original legal text.
