There is hereby created a Respiratory Care Advisory\n\nCommittee within the State Board of Medical Licensure and\n\nSupervision, hereinafter referred to as the Committee, to assist in\n\nadministering the provisions of the Respiratory Care Practice Act.\n\nThe Committee shall consist of nine (9) members, appointed as\n\nfollows:\n\na. one member shall be a physician appointed by the Board\n\nfrom its membership,\n\nb. one member shall be a physician appointed by the Board\n\nfrom a list of qualified individuals submitted by the\n\nOklahoma State Medical Association and who is not a\n\nmember of the Board,\n\nc. one member shall be a physician appointed by the State\n\nBoard of Osteopathic Examiners from its membership,\n\nd. one member shall be a physician appointed by the State\n\nBoard of Osteopathic Examiners from a list of\n\nqualified individuals submitted by the Oklahoma\n\nOsteopathic Association and who is not a member of the\n\nState Board of Osteopathic Examiners, and\n\ne. five members shall be licensed respiratory care\n\npractitioners appointed by the Board from a list of\n\nrespiratory care practitioners submitted by the\n\nOklahoma Society for Respiratory Care (OSRC).\n\n2. Other than the physicians appointed from the membership of\n\nthe State Board of Medical Licensure and Supervision and of the\n\nState Board of Osteopathic Examiners, the physician members shall\n\nhave special qualifications in the diagnosis and treatment of\n\nrespiratory problems and, wherever possible, be qualified in the\n\nmanagement of acute and chronic respiratory disorders.\n\n3. The respiratory care practitioner members shall have been\n\nengaged in rendering respiratory care services to the public,\n\nteaching or research in respiratory care for at least five (5) years\n\nimmediately preceding their appointments. These members shall at\n\nall times be holders of valid licenses for the practice of\n\nrespiratory care in this state, except for the members first\n\nappointed to the Committee. These initial members shall, at the\n\ntime of appointment, be credentialed as a Registered Respiratory\n\nTherapist (RRT) or current equivalent credential as identified by\n\nthe Respiratory Care Advisory Committee and approved by the State\n\nBoard of Medical Licensure and Supervision.\n\nB. Members of the Committee shall be appointed for terms of\n\nfour (4) years. Provided, the terms of office of the members first\n\nappointed shall begin November 1, 1995, and shall continue for the\n\nfollowing periods: two physicians and two respiratory care\n\npractitioners for a period of three (3) years; and two physicians\n\nand three respiratory care practitioners for a period of four (4)\n\nyears. Upon the expiration of a member's term of office, the\n\nappointing authority for that member shall appoint a successor\n\npursuant to the provisions of subsection C of this section.\n\nVacancies on the Committee shall be filled in like manner for the\n\nbalance of an unexpired term. No member shall serve more than three\n\nconsecutive terms. Each member shall serve until a successor is\n\nappointed and qualified.\n\nC. Upon expiration or vacancy of the term of a member, the\n\nrespective nominating authority may, as appropriate, submit to the\n\nappointing Board a list of three persons qualified to serve on the\n\nCommittee to fill the expired term of their respective member.\n\nAppointments may be made from these lists by the appointing Board,\n\nand additional lists may be provided by the respective organizations\n\nif requested by the State Board of Medical Licensure and\n\nSupervision.\n\nD.
