Upon filing of a written complaint with the State Board of\n\nMedical Licensure and Supervision, charging a person with any of the\n\nacts described in Section 15 of this act, the authorized employee of\n\nthe Board may make an investigation. If the Board finds reasonable\n\ngrounds for the complaint, a time and place for a hearing shall be\n\nset, notice of which shall be served on the licensee, or applicant\n\nat least fifteen (15) calendar days prior thereto. The notice shall\n\nbe by personal service or by certified or registered mail sent to\n\nthe last-known address of the person.\n\nB. The Board or its designee may issue subpoenas for the\n\nattendance of witnesses and the production of necessary evidence on\n\nany investigation or hearing before it. Upon request of the\n\nrespondent or the respondent's counsel, the Board may issue\n\nsubpoenas on behalf of the respondent.\n\nC. Unless otherwise provided in the Respiratory Care Practice\n\nAct, hearing procedures shall be conducted in accordance with, and a\n\nperson who feels aggrieved by a decision of the Board may make an\n\nappeal pursuant to, Article II of the Administrative Procedures Act.\n\nD. If found to be guilty as charged, the practitioner shall pay\n\nfor all costs incurred by the Board.\n\nE.
