Any person who has been determined by the State Board of\n\nExaminers of Perfusionists to have violated any provision of the\n\nOklahoma Licensed Perfusionists Act or any rule or order issued\n\npursuant thereto may be liable for an administrative penalty of not\n\nmore than Five Hundred Dollars ($500.00) for each day that said\n\nviolation continues. The maximum administrative penalty shall not\n\nexceed Ten Thousand Dollars ($10,000.00) for any related series of\n\nviolations that do not constitute immediate jeopardy to patients.\n\nPenalties of not more than One Thousand Dollars ($1,000.00) per day\n\nmay be imposed for violations constituting immediate jeopardy to\n\nresidents.\n\n2. The amount of the penalty shall be assessed by the Board\n\npursuant to the provisions of paragraph 1 of this subsection, after\n\nnotice and hearing. In determining the amount of the penalty, the\n\nBoard shall include but not be limited to consideration of the\n\nnature, circumstances, and gravity of the violation, the repetitive\n\nnature of the violation of the person, the previous degree of\n\ndifficulty in obtaining compliance with the Oklahoma Licensed\n\nPerfusionists Act or the rules promulgated pursuant thereto and,\n\nwith respect to the person found to have committed the violation,\n\nthe degree of culpability, and substantial show of good faith in\n\nattempting to achieve compliance with the provisions of the Oklahoma\n\nLicensed Perfusionists Act.\n\n3. Any license holder may elect to surrender the license of\n\nsuch holder in lieu of said penalty but shall be forever barred from\n\nobtaining a reissuance of the license pursuant to the Oklahoma\n\nLicensed Perfusionists Act.\n\nB.
