Stat. tit. 59, § 59-2095.17","heading":"Penalties authorized - Cease and desist orders -","body":"Administrative hearings.\n\nA. In order to ensure the effective supervision and enforcement\n\nof the Oklahoma Secure and Fair Enforcement for Mortgage Licensing\n\nAct, the Administrator of Consumer Credit may, after notice and\n\nhearing pursuant to Article II of the Administrative Procedures Act,\n\nimpose any or any combination of the following penalties:\n\n1. Deny, suspend, revoke, censure, place on probation or\n\ndecline to renew a license for a violation of the Oklahoma Secure\n\nand Fair Enforcement for Mortgage Licensing Act, any rules\n\npromulgated pursuant to the Oklahoma Secure and Fair Enforcement for\n\nMortgage Licensing Act and any order of the Administrator or an\n\nindependent hearing examiner issued pursuant to the Oklahoma Secure\n\nand Fair Enforcement for Mortgage Licensing Act;\n\n2. Deny, suspend, revoke, censure, place on probation or\n\ndecline to renew a license if an applicant or licensee fails at any\n\ntime to meet the requirements of the Oklahoma Secure and Fair\n\nEnforcement for Mortgage Licensing Act or withholds information or\n\nmakes a material misstatement in an application for a license or\n\nrenewal of a license;\n\n3. Order restitution against entities or individuals subject to\n\nthe Oklahoma Secure and Fair Enforcement for Mortgage Licensing Act\n\nfor violations of the Oklahoma Secure and Fair Enforcement for\n\nMortgage Licensing Act; or\n\n4. Issue orders or directives under the Oklahoma Secure and\n\nFair Enforcement for Mortgage Licensing Act as follows:\n\na. order or direct entities or individuals subject to the\n\nOklahoma Secure and Fair Enforcement for Mortgage\n\nLicensing Act to cease and desist from conducting\n\nbusiness, including immediate temporary orders to\n\ncease and desist,\n\nb. order or direct entities or individuals subject to the\n\nOklahoma Secure and Fair Enforcement for Mortgage\n\nLicensing Act to cease any harmful activities or\n\nviolations of the Oklahoma Secure and Fair Enforcement\n\nfor Mortgage Licensing Act, including immediate\n\ntemporary orders to cease and desist,\n\nc. enter immediate temporary orders to cease business\n\nunder a license issued pursuant to the authority of\n\nthe Oklahoma Secure and Fair Enforcement for Mortgage\n\nLicensing Act if the Administrator or an independent\n\nhearing examiner determines that such license was\n\nerroneously granted or the licensee is currently in\n\nviolation of the Oklahoma Secure and Fair Enforcement\n\nfor Mortgage Licensing Act,\n\nd. order or direct such other affirmative action as the\n\nAdministrator or an independent hearing examiner deems\n\nnecessary, or\n\ne. impose a civil penalty of not less than One Hundred\n\nDollars ($100.00) nor more than Two Thousand Five\n\nHundred Dollars ($2,500.00) for each violation of the\n\nOklahoma Secure and Fair Enforcement for Mortgage\n\nLicensing Act against a licensee or any other entity\n\nor individual subject to the Oklahoma Secure and Fair\n\nEnforcement for Mortgage Licensing Act, not to exceed\n\nFive Thousand Dollars ($5,000.00) for all violations\n\nresulting from a single incident or transaction.\n\nB. Any immediate temporary order to cease and desist issued\n\npursuant to the Oklahoma Secure and Fair Enforcement for Mortgage\n\nLicensing Act shall comply with the requirements for emergency\n\norders under Article II of the Administrative Procedures Act.\n\nC. Any administrative order or settlement agreement imposing a\n\ncivil penalty pursuant to this section may be enforced in the same\n\nmanner as civil judgments in this state. The Administrator may file\n\nan application to enforce an administrative order or settlement\n\nagreement in the district court of Oklahoma County.\n\nD. The Administrator shall appoint an independent hearing\n\nexaminer to conduct all administrative hearings involving alleged\n\nviolations of the Oklahoma Secure and Fair Enforcement for Mortgage\n\nLicensing Act. The independent hearing examiner shall have\nThe Administrator may file\n\nan application to enforce an administrative order or settlement\n\nagreement in the district court of Oklahoma County.\n\nD. The Administrator shall appoint an independent hearing\n\nexaminer to conduct all administrative hearings involving alleged\n\nviolations of the Oklahoma Secure and Fair Enforcement for Mortgage\n\nLicensing Act. The independent hearing examiner shall have\n\nauthority to exercise all powers granted by Article II of the\n\nAdministrative Procedures Act in conducting hearings. The\n\nindependent hearing examiner shall have authority to recommend\n\npenalties authorized by the Oklahoma Secure and Fair Enforcement for\n\nMortgage Licensing Act and issue proposed orders, with proposed\n\nfindings of fact and proposed conclusions of law, to the\n\nAdministrator pursuant to Article II of the Administrative\n\nProcedures Act. The Administrator shall review the proposed order\n\nand issue a final agency order in accordance with Article II of the\n\nAdministrative Procedures Act. Any person aggrieved by a final\n\nagency order of the Administrator may obtain judicial review in\n\naccordance with the Oklahoma Administrative Procedures Act. The\n\nvenue of any such action shall be in the district court of Oklahoma\n\nCounty.
