Stat. tit. 59, § 59-2095.27","heading":"Permitting employees and independent contractors to","body":"work at remote locations.\n\nA licensee may permit its employees or independent contractors\n\nto work at remote locations in compliance with the licensee’s\n\nwritten policies and procedures subject to the following conditions:\n\n1. The licensee has written policies and procedures for\n\nsupervision of employees and independent contractors working from\n\nremote locations;\n\n2. Access to a licensee’s platforms and customer information\n\nshall be in accordance with the licensee’s comprehensive written\n\ninformation security plan;\n\n3. No in-person customer interaction shall occur at an\n\nemployee’s or independent contractor’s residence unless such\n\nresidence is a licensed or registered location;\n\n4. Physical records shall not be maintained at a remote\n\nlocation;\n\n5. Interactions with and conversations about consumers shall be\n\nin compliance with federal and state information security\n\nrequirements, including applicable provisions under the Gramm-Leach-\n\nBliley Act and the Safeguards Rule established under the Federal\n\nTrade Commission, set forth in 16 CFR Part 314, as such may be\n\namended from time to time;\n\n6. Employees or independent contractors working at a remote\n\nlocation shall have access to the licensee’s secure systems,\n\nincluding a cloud-based system, directly from any out-of-office\n\ndevice that such employee or independent contractor may use\n\nincluding, but not limited to, a laptop, mobile phone, desktop\n\ncomputer, or tablet, via a virtual private network, or comparable\n\nsystem, that ensures secure connectivity and requires passwords or\n\nforms of authentication to access;\n\n7. The licensee shall ensure that appropriate security updates,\n\npatches, or other alterations to the security of all devices used at\n\nremote locations are installed and maintained;\n\n8. The licensee shall have an ability to remotely lock or erase\n\ncompany-related contents of any device or other otherwise remotely\n\nlimit all access to the licensee’s secure systems; and\n\n9.
