In order to meet the written test requirement referred to in\n\nSection 2095.7 of this title, an individual shall pass, in\n\naccordance with standards established under this section, a\n\nqualified written test developed by the Nationwide Multistate\n\nLicensing System and Registry and administered by a test provider\n\napproved by the Nationwide Multistate Licensing System and Registry\n\nbased upon reasonable standards.\n\nB. A written test shall not be treated as a qualified written\n\ntest for purposes of subsection A of this section unless the test\n\nadequately measures the applicant’s knowledge and comprehension in\n\nappropriate subject areas, including:\n\n1. Ethics;\n\n2. Federal law and regulations pertaining to mortgage\n\norigination;\n\n3. State law and regulation pertaining to mortgage origination;\n\nand\n\n4. Federal and state law and regulation, including instruction\n\non fraud, consumer protection, the nontraditional mortgage\n\nmarketplace and fair lending issues.\n\nC. Nothing in this section shall prohibit a test provider\n\napproved by the Nationwide Multistate Licensing System and Registry\n\nfrom providing a test at the location of the employer of the\n\napplicant or the location of any subsidiary or affiliate of the\n\nemployer of the applicant or the location of any entity with which\n\nthe applicant holds an exclusive arrangement to conduct the business\n\nof a mortgage loan originator.\n\nD. 1. An individual shall not be considered to have passed a\n\nqualified written test unless the individual achieves a test score\n\nof not less than seventy-five percent (75%) correct answers to\n\nquestions.\n\n2. An individual may retake a test three consecutive times with\n\neach consecutive taking occurring at least thirty (30) days after\n\nthe preceding test.\n\n3. After failing three consecutive tests, an individual shall\n\nwait at least six (6) months before taking the test again.\n\n4.
