The certificate of operation fee for newly installed\n\nelevators, platform lifts, and stairway chairlifts for private\n\nresidences shall be subsequent to an inspection by a third party\n\ninspector or by the Commissioner or his or her designee.\n\nB. A third party inspector or the Commissioner, or his or her\n\ndesignee, shall inspect, in accordance with the requirements set\n\nforth in this chapter, all newly installed elevators, platform\n\nlifts, and stairway chairlifts for private residences. For newly\n\ninstalled residential elevators and other residential elevators, the\n\ninspector shall note on the inspection report compliance with the\n\napplicable codes governing protection of hoist way openings,\n\ncommonly known as the 3x5 rule.\n\nC. An owner, operator or installer of a new residential\n\nelevator may voluntarily request the Department of Labor to conduct\n\na review of a planned new installation for compliance with the\n\nprovisions of the Elevator Safety Act and Department regulations.\n\nThe review shall be performed in accordance with Department\n\nregulations regarding installation permits. The Department may\n\ncharge a fee for the review as established by rule.
