Stat. tit. 59, § 59-3024","heading":"Commissioner of Labor, powers and duties - Fees - Deposit","body":"of revenues - License and certification renewal\n\nA. The Commissioner of Labor shall have the following powers\n\nand duties:\n\n1. The Commissioner shall:\n\na. adopt or determine standards of elevator safety,\n\nb. license elevator contractors, elevator mechanics, and\n\nelevator inspectors,\n\nc. register elevator apprentices,\n\nd. determine qualifications for examination, establish\n\napplication processes, and examine applicants for\n\nlicensure,\n\ne. establish terms of licensure and renewal procedures,\n\nf. attempt to achieve reciprocity agreements whereby\n\nlicenses issued by other jurisdictions may be accepted\n\nin this state in lieu of examination,\n\ng. establish grounds for revocation, suspension, and\n\nnonrenewal of licenses and policies for reinstatement\n\nof licenses and for imposition of lesser disciplinary\n\nmeasures,\n\nh. establish continuing education requirements,\n\ni. provide for the inspection and certification of\n\nelevators,\n\nj. provide for the enforcement of the Elevator Safety\n\nAct,\n\nk. hear appeals pursuant to the Administrative Procedures\n\nAct,\n\nl. establish a procedure for the reporting and\n\ninvestigation of accidents, and\n\nm. establish a procedure to allow variances from the\n\nliteral requirement of the code;\n\n2. The Commissioner shall publish informational brochures about\n\nlicense examinations that indicate the scope of the examinations,\n\ninclude suggestions about how to prepare for the examinations, and\n\nmay include sample questions of the type to be expected, but shall\n\nnever include test items that will be used in future examinations.\n\nIn no case shall information about forthcoming examinations, that is\n\nnot generally available, be given to any school, coaching service,\n\nor individual privately; and\n\n3. The Commissioner shall have subpoena powers and shall have\n\nthe right to seek injunctive relief to prevent the operation of\n\nelevators lacking a certificate of operation after November 1, 2006,\n\nor failing inspection. For any violation of the Elevator Safety\n\nAct, the Commissioner may assess an administrative fine , which fine\n\nmay be assessed in addition to any other penalties provided pursuant\n\nto the Elevator Safety Act. The Commissioner of Labor may\n\npromulgate rules establishing a schedule of administrative fines for\n\nviolations of the Elevator Safety Act. Upon collection of an\n\nassessed fine, the funds shall be deposited in the Department of\n\nLabor Administrative Penalty Revolving Fund created in Section 11 of\n\nthis act.\n\nB. The Commissioner of Labor may promulgate rules establishing\n\na schedule of administrative fees for the implementation of the\n\nElevator Safety Act. The following fees shall remain in effect\n\nuntil such rules become effective, at which time the fees contained\n\nin this subsection shall be superseded by rule. Fees shall be as\n\nfollows:\n\n1. Elevator contractor examination $100.00\n\n2. Elevator inspector examination $100.00\n\n3. Elevator mechanic examination $100.00\n\n4. Initial and renewal elevator\n\ncontractor license $100.00\n\n5. Initial and renewal elevator\n\ninspector License $ 75.00\n\n6. Initial and renewal elevator\n\nmechanic License $ 50.00\n\n7. Annual elevator apprentice\n\nregistration $ 25.00\n\n8. Late renewal - in addition to\n\nlicense fee $ 10.00\n\n9. Replacement of lost or mutilated\n\nlicense $ 10.00\n\n10. Reinstatement - in addition to\n\nlicense fee $100.00\n\n11. Existing elevator - certification\n\nof operation $ 25.00\n\n12. New elevator - inspection and\n\ncertification $150.00\n\n13. Elevator temporary certification $ 25.00\n\n14. Elevator temporary mechanic\n\nlicense for 30 days $ 10.00\n\n15. Labor for chief elevator inspector\n\nor deputy elevator inspector to\n\nperform inspection for issuance of\n\ncertificate of operation:\n\na. any escalator or moving walkway $125.00\n\nb. elevator, two-four floors $ 75.00\n\nc. elevator, five-ten floors $100.00\nnspection and\n\ncertification $150.00\n\n13. Elevator temporary certification $ 25.00\n\n14. Elevator temporary mechanic\n\nlicense for 30 days $ 10.00\n\n15. Labor for chief elevator inspector\n\nor deputy elevator inspector to\n\nperform inspection for issuance of\n\ncertificate of operation:\n\na. any escalator or moving walkway $125.00\n\nb. elevator, two-four floors $ 75.00\n\nc. elevator, five-ten floors $100.00\n\nd. elevator, eleven floors and over $125.00\n\ne. wheelchair lift $ 25.00\n\nC. All revenues received shall be deposited to the Department\n\nof Labor Revolving Fund. It is the intent of the Legislature that\n\nfees charged pursuant to the Elevator Safety Act be adjusted to\n\nprovide sufficient income, but not substantially more than\n\nsufficient income, to ensure elevator safety as provided by the\n\nElevator Safety Act. Accordingly, the Commissioner of Labor shall\n\nmake an annual study of the revenues to and expenditures from the\n\nDepartment of Labor Revolving Fund related to elevator safety and\n\nshall prepare a report indicating what fee adjustments, if any,\n\nshall be recommended. The report shall be submitted by September 1\n\neach year to the Director of the Office of Management and Enterprise\n\nServices, the Chair of the Appropriations Committee of the Senate,\n\nand the Chair of the Appropriations and Budget Committee of the\n\nHouse of Representatives, and shall be filed with the Department of\n\nLabor.\n\nD. Licenses and certifications issued in accordance with the\n\nprovisions of the Elevator Safety Act shall be renewed according to\n\nthe following schedule:\n\n1. Elevator contractor, elevator inspector, elevator mechanic\n\nlicenses and elevator apprentice registration shall be renewed\n\nannually prior to the last day of the calendar month in which the\n\nlicense or registration was initially issued;\n\n2. Any such license, registration or certificate required by\n\nthe Elevator Safety Act not renewed by the last day of the calendar\n\nmonth in which renewal is required shall be subject to a late fee as\n\nprovided by this act;\n\n3. Any elevator contractor, elevator inspector, elevator\n\nmechanic license or apprentice registration having been expired for\n\na period of not less than thirty (30) days nor more than three\n\nhundred sixty-five (365) days shall be subject to a reinstatement\n\nfee as provided for in the Elevator Safety Act; and\n\n4. Any elevator contractor, elevator inspector, elevator\n\nmechanic license or apprentice registration being expired for a\n\nperiod of one (1) year or longer from the last day of the month in\n\nwhich renewal was required shall be considered void and the licensee\n\nshall be subject to all requirements for new issuance.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a907dfa743dcb8b52e43c54174e67f2e568547565318b636a2bf6f5495153510","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-3023.6","next":"us-ok/okla.-stat.-tit.-59-59-3040.1"},"notice":"GroundRules: Original legal text.
